Sisk stated that as part of the 1985 Agreement the zoning was <br />specified as entirely B-O, Business-Office. He wondered if it is <br />Eastcor's position that anything coming in would be part of B-O <br />zoning. <br /> <br />Junge stated that the answer is "yes." He commented that they are <br />not asking for anything on the Master Plan approval that is <br />inconsistent with the B-O zone. He stated that after they get past <br />the first two users, before they ever come with the third use, they <br />would bring back to Council for policy and then through the <br />Planning Commission, a full Master Plan. <br /> <br />Howard proposed that the City and developer split the difference <br />between the $6,000 and approximately $40,000 on the cash-in-lieu of <br />to help ease the inequity of the situation. <br /> <br />Hadjis stated that originally they had in the Plat an outlot (just <br />under 5,000 s.f.) on the corner of the site as dedication to the <br />City. It is not on the present Plat because the setbacks are still <br />there. It will still be green space and landscaped, and there <br />won't be drainage or anything on it. It qualifies as open space. <br />He felt that if that was Council's desire, he felt they could give <br />up that land and go up to $10,000 as cash-in-lieu. He stated that <br />they have also agreed to pay for 1/4 of a traffic signal. <br /> <br />Davidson preferred that the outlot be retained and maintained by <br />the developer as an amenity to the development. <br /> <br />Levihn stated that he was not in favor of a gas station on the <br />property with the pre-school. He felt the time frame of ten years <br />on this Agreement was too long. <br /> <br />Howard moved that Council approve Resolution No. 24, Series 1994, <br />Lot 2, Final Plat, Final PUD, Century Office Park with the <br />amendment that the amount for the open space dedication be $10,000. <br />Seconded by Mayer. <br /> <br />Mayer offered friendly amendments that the Century Circle be signed <br />for no parking and that the signage for Children's World be <br />adjusted to be a non-interior lighted sign. <br /> <br />Howard accepted both amendments. <br /> <br />Roll call was taken. Motion passed by a 5 - 0 vote with Keany <br />being absent and Lathrop being excused. <br /> <br />RESOLUTION NO. 26, SERIES 1994 - A FINAL PUD DEVELOPMENT PLAN FOR <br />LOT 1 (LAFAYETTE STATE BANK) - CENTURY OFFICE PARK <br /> <br />Paul Wood, Planning Director, stated that the PUD shows a two-story <br />bank and office building with five drive-through lanes.
