It won't <br />be done for a few months. <br /> <br />Lathrop asked Brisnehan if he would be willing to agree not to start construction until that is <br />approved. <br /> <br />Brisnehan recommended that staff reword Resolution No. 3.4, No. 1. <br /> <br />Sisk stated that the Public Service right-of-way cannot be used as part of their open space dedication. <br /> <br />Brisnehan stated that the designation for the open space on this tract, was done way before Council <br />passed that regulation. He commented that, if Council preferred not to have that open space <br />dedication, they are prepared to take it back and give the City cash-in-lieu. <br /> <br />Sisk stated that Council did not want cash-in-lieu. <br /> <br />Davidson clarified that the original ordinance that talks about the dedication of open space does not <br />mention power lines specifically, but has language referring to junk land. Resolution No. 36 just <br />clarified the original ordinance and no change was made. The rules in effect now are the same rules <br />that were in effect then. The only change made was that Council preferred not to have cash-in-lieu <br />of. <br /> <br />Sisk asked how they felt they met the open space dedication of 12%. <br /> <br />Brisnehan stated that there is a general development plan done declaring what they are trying to do <br />right now, including drain Hecla Lake, giving them 100% credit for the land. Hecla Lake is figured <br />as part of their open space requirement. <br /> <br />Sisk wondered if the right-of-way dedication for Hwy. 42 was calculated in their open space <br />dedication. <br /> <br />Brisnehan stated that the highway dedication for Hwy 42 is deleted from the gross property and not <br />part of the dedication. <br /> <br />Sisk asked how many square feet they were dedicating to Louisville for open space dedication as part <br />of the total subdivision. <br /> <br />Wood stated that Tract A is 84, 280 s.f. or 1.93 acres, not including the 25' right-of-way dedication <br />along Hwy. 42. <br /> <br /> <br />
