Davidson stated that this would produce between $1,800 and $3,000+/home, depending on the size
of the home. He explained that, since this was the range Council was looking at for an school impact
fee, this looked like a logical approach for Council to take.

Davidson called for Council comments or questions.

Lathrop was in favor of this.

Mayer was not happy with the way the ordinance was drafted. He felt the main emphasis should be
the high schools. He wanted the city to have the flexibility to apply some of the fee to other schools,
as necessary. He wanted the ordinance changed to reflect that.

Keany wanted more flexibility as to how the city can use the monies, such as school capacity.

Margaret Hombostel, 655 West Hawthorn Street, Louisville, Colorado, was on the task force for this
a couple of years ago. She explained that they discussed a problem the city had with being a statutory
city in collecting these fees. State statutory cities have to depend on the desires of other statutory
cities. Chartered cities are able to hire auditors to make sure they get these fees. She wanted that
addressed and that whoever comes in ahead of this is not "grandfathered" in.

Davidson stated that this is one that the city clearly has the authority to impose. Since it is a tax,
there is no "grandfathering."

Howard wanted flexibility with the funds.

Levihn felt that the city should hold the money until such time as the total District goes to this type
of a fee and the city should influence the use of the money to the benefits of Louisville.

Davidson stated that on page 2, item A, line A, the words "solely for" should be removed and
replaced with "for uses such as."

Davidson called for further Council discussion.

NONE

Davidson moved that Council instruct the City Attorney to go forward per the schedule. Seconded
by Levihn. All in favor.

EXECUTIVE SESSION

Acting City Attorney requested that Council go into Executive Session to discuss a proposed
settlement agreement and release that would be entered into with the owners of Centennial

10
