Louisville City Council Meeting May 6, 2003 Page 3 of 11 ORDINANCE NO. 1415, SERIES 2003 - AN ORDINANCE APPROVING AN ANNEXATION, KNOWN AS THE RAY ANNEXATION, TO THE CITY OF LOUISVILLE, COLORADO - 2nd reading - public hearing (advertised Daily Camera 04/26/03) ORDINANCE NO. 1416, SERIES 2003 - AN ORDINANCE ZONING PROPERTY ANNEXED TO THE CITY OF LOUISVILLE AND KNOWN AS THE RAY ANNEXATION - 2nd reading - public hearing (advertised Daily Camera 04/26/03) Davidson called for City Attorney introduction. City Attorney Sam Light read Ordinance Nos. 1415, and 1416, Series 2003. Davidson called for Staff presentation. Principal Planner Ken Johnstone reported that Ordinance No. 1415, Series 2003 annexes a .56-acre parcel known as the Ray Annexation. The property owners, James S. Ray and Christina Dozauer-Ray, have submitted an annexation petition to commence the annexation process with the City of Louisville. The property is approximately 24,472 SF and is located at 100 W. Spruce Street. Approximately 7,986 SF of that gross total is located within the Spruce Street right-of-way and the net area is 16,486 SF. The subject property has frontage on West Spruce Street and has contiguity with the City on the north, east and west boundaries. Johnstone reported that Ordinance No. 1416, Series 2003 would zone the .56-acre parcel annexed under the Ray Annexation to City of Louisville Single Family Medium Density (SF-MD). The zoning request is consistent with the terms of a pre-annexation letter of agreement stipulating that upon the effective date of the annexation, the owner will convey a conservation easement to the City restricting the property to one primary, single family dwelling unit. The SF-MD District requires a minimum lot area of 12,000 SF. The SF-MD Zone District is consistent with the zoning of the adjacent property to the east, which was recently annexed as the Schreiter/Slavec Annexation. Davidson opened the public hearing and asked if anyone in the audience wished to speak for or against Ordinance Nos. 1415 and 1416, Series 2003. Hearing none, Davidson closed the public hearing. MOTION: Sisk moved that Council approve Ordinance No. 1415, Series 2003, seconded by Brown. Roll call vote was taken. The motion passed by a vote of 5-0. Van Pelt and Marsella absent. MOTION: Sisk moved that Council approve Ordinance No. 1416, Series 2003, contingent upon finalization of an annexation agreement signed by the Mayor, seconded by Levihn. Roll call vote was taken.
