Louisville City Council Meeting <br />May 6, 2003 <br />Page 3 of 11 <br /> <br />ORDINANCE NO. 1415, SERIES 2003 - AN ORDINANCE APPROVING AN <br />ANNEXATION, KNOWN AS THE RAY ANNEXATION, TO THE CITY OF <br />LOUISVILLE, COLORADO - 2nd reading - public hearing (advertised Daily <br />Camera 04/26/03) <br /> <br />ORDINANCE NO. 1416, SERIES 2003 - AN ORDINANCE ZONING PROPERTY <br />ANNEXED TO THE CITY OF LOUISVILLE AND KNOWN AS THE RAY <br />ANNEXATION - 2nd reading - public hearing (advertised Daily Camera 04/26/03) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />City Attorney Sam Light read Ordinance Nos. 1415, and 1416, Series 2003. <br /> <br />Davidson called for Staff presentation. <br /> <br />Principal Planner Ken Johnstone reported that Ordinance No. 1415, Series 2003 annexes <br />a .56-acre parcel known as the Ray Annexation. The property owners, James S. Ray and <br />Christina Dozauer-Ray, have submitted an annexation petition to commence the <br />annexation process with the City of Louisville. The property is approximately 24,472 SF <br />and is located at 100 W. Spruce Street. Approximately 7,986 SF of that gross total is <br />located within the Spruce Street right-of-way and the net area is 16,486 SF. The subject <br />property has frontage on West Spruce Street and has contiguity with the City on the <br />north, east and west boundaries. <br /> <br />Johnstone reported that Ordinance No. 1416, Series 2003 would zone the .56-acre parcel <br />annexed under the Ray Annexation to City of Louisville Single Family Medium Density <br />(SF-MD). The zoning request is consistent with the terms of a pre-annexation letter of <br />agreement stipulating that upon the effective date of the annexation, the owner will <br />convey a conservation easement to the City restricting the property to one primary, single <br />family dwelling unit. The SF-MD District requires a minimum lot area of 12,000 SF. <br />The SF-MD Zone District is consistent with the zoning of the adjacent property to the <br />east, which was recently annexed as the Schreiter/Slavec Annexation. <br /> <br />Davidson opened the public hearing and asked if anyone in the audience wished to speak <br />for or against Ordinance Nos. 1415 and 1416, Series 2003. Hearing none, Davidson <br />closed the public hearing. <br /> <br />MOTION: Sisk moved that Council approve Ordinance No. 1415, Series 2003, <br />seconded by Brown. Roll call vote was taken. The motion passed by a vote of 5-0. Van <br />Pelt and Marsella absent. <br /> <br />MOTION: Sisk moved that Council approve Ordinance No. 1416, Series 2003, <br />contingent upon finalization of an annexation agreement signed by the Mayor, seconded <br />by Levihn.
