Louisville City Council Meeting
May 6, 2003

Davidson explained the problem is the result of the developer building large homes on
small lots.

Sisk asked if Resolution No. 14, Series 2003, included all the homes in the Meadows
subdivision. Johnstone responded yes, however, another draft of the resolution includes
only the 57 lots.

Sisk suggested Council adhere to the Home Owner Association's original proposal.
Davidson agreed, and suggested the resolution recommending the 57 lots be submitted
for the next Council meeting under Consent Agenda Items.

MOTION: Davidson moved that Council table Resolution No. 14, Series 2003, to the
May 20, 2003 meeting, seconded by Sisk. All in favor. Marsella absent.

AUTHORIZE EXECUTION OF PUBLIC UTILITIES COMMISSION
APPLICATION FOR BNSF FUNDING OF RAILROAD BRIDGE STRUCTURE
FOR THE HIGHWAY 42/96m STREET CONNECTION PROJECT

Davidson called for Staff presentation.

Public Works Director Tom Phare reported that Public Utilities Commission (PUC)
approval is required for all new railroad crossings, including the proposed bridge
structure that will cross the Burlington Northern Santa Fe (BNSF) railroad as part of the
96th Street/SH 42 Connection project. He noted there is also an opportunity, through this
PUC application, to require the BNSF railroad to provide funding for this project. As part
of the funding request, the City is required to close two existing at-grade railroad
crossings at Lock Street and South Street. At Lock Street, an alternative access must be
given to local property owners by extending the street east to the proposed 96th Street/SH
42 intersection. The Lock Street crossing would only need to be closed if a railroad
funding agreement were successfully negotiated.

MOTION: Sisk moved that Council authorize the execution of PUC Application for
BNSF Funding of Railroad Bridge Structure for the 96th/sH 42 Connection Project,
seconded by Brown. All in favor. Marsella absent.

AWARD BID FOR 2003 STREET RECONSTRUCTION & CONCRETE
REPLACEMENT PROJECT

Davidson called for Staff presentation.

'Public Works Director Tom Phare reported on April 29, 2003, four bids were received
and opened for the 2003 Street Reconstruction and Concrete Replacement Project. The
low bid was from Lafarge West, Inc, for $1,129,017.35. He noted soft cost such as
engineering, material testing, design and construction surveying, traffic signal facility
repairs, etc., is estimated at $108,000. He stated Staff is requesting a project contingency
