Howard opened the public hearing calling for anyone wishing to speak on Ordinance No. 1153. <br /> <br />NONE <br /> <br />Howard closed the public hearing and called for Council questions, comments, or motions. <br /> <br />Mayer moved that Council adopt Ordinance No. 1153, Series 1994, on second and final reading, <br />zoning the Warembourg property as Agricultural. Seconded by Levihn. Roll call was taken. Motion <br />passed by a 6 - 0 vote with Davidson being absent. <br /> <br />RESOLUTION NO. 39, SER1ES 1994 - APPROVING A FINAL SUBDIVISION PLAT FOR <br />THE WAREMBOURG SUBDIVISION <br /> <br />Paul Wood, Planning Director, stated that this is in conjunction with the annexation and zoning of <br />the property and it covers the full 92 acres, which is proposed as four lots and two outlots. On June <br />14, 1994, the Planning Commission approved a resolution recommending approval of the final <br />subdivision plat. There is a name change proposed: Jackson Street, that portion of the property that <br />adjoins lots 1, 2, and 3 will become Cherry Street. <br /> <br />Howard opened the public hearing calling for anyone wishing to speak on Resolution No. 39. <br /> <br />CJreg Oxenfeld, 151 South Carter Court, Louisville, Colorado, read a petition (SEE ATTACHED) <br />he and his neighbors had signed and delivered to City Hall February, 8, 1994. He stated that there <br />had been accidents at the curve just west of South Carter Court. He was concerned that once the <br />city decides the uses to occur on the open space, there may be a need for secondary access and the <br />city would have spend additional tax money to acquire the needed land for access. He suggested that <br />the Warembourgs dedicate an access easement along the west side of their property, which may be <br />released once the city has acquired the Daughenbaugh property or has another secondary access <br />alternative. He wondered what would happen with the barbed wire fence surrounding the property. <br />He wondered if the city was considering flood irrigating this property and how will the property be <br />maintained during the interim before any final decisions were made. He requested that before any <br />decision is made on the fences along the rear of the lots on South Carter, the public be allowed to <br />comment at a separate public heating. He wanted the Warembourgs to consider some type of fencing <br />that is compatible with the surrounding area. Oxenfeld requested that the Council consider replacing <br />the existing overhead power line along Bella Vista Avenue that currently serves the Warembourg <br />house. He wanted as many trees saved as possible. He suggested conditions for approval (SEE <br />ATTACHED). <br /> <br />Howard called for any other comments from the audience. <br /> <br />NONE <br /> <br />Howard closed the public hearing and called for Council comments or questions. <br /> <br />4 <br /> <br /> <br />
