last sentence of Section 7 which would read that "if the revenues from the Use Tax on the extension <br />to construction and residential building projects can't be used for school purposes, then the tax would <br />remain valid, but the revenues would be split 50% to the Combined Capital Improvement fund and <br />50% to the Conservation Trust Fund." She stated that Council left C3 alone and made those changes <br />instead to the last sentence of Section 7, it would be correct. She stated that Sharon Asti-Caranci <br />pointed out that currently the Use Tax from the Construction Building Materials for Commercial <br />Purposes is currently going to the city's Capital Projects Fund rather than to the General Fund, so <br />they may wish to change C3 to refer to the city's Capital Projects Fund rather than the General Fund. <br /> <br />Mayer moved that Council approve Ordinance No. 1157, Series 1994, with the City Attorney's <br />suggestions. Seconded by Howard. <br /> <br />Griffiths: <br /> <br />For clarification, you would be approving Ordinance <br />No. 1157, on second reading with the amendments <br />that would make the extension of the Use Tax to <br />residential construction and building materials effective <br />for nine years. The extension would begin <br />immediately after the election, if approved by the <br />voters, and we would change the wording of Section <br />7 as I've noted. Then, Section C3 would be amended <br />to say "all revenues, except as provided in paragraphs <br />1 & 2 of sub-Section C, all revenues from the Use Tax <br />shall be deposited in the city's Capital Projects Fund." <br /> <br />Asti-Caranci: <br /> <br />That only means Use Tax on building materials. It <br />doesn't mean auto Use Tax. <br /> <br />Griffiths: <br /> <br />No, that's not correct the way it's currently written. <br />C3 reflects the current wording of the city's Code <br />which says all of the remaining revenues, which would <br />be the Use Tax on commercial construction materials <br />and autos, would be deposited in the city's General <br />Fund and use for municipal purposes. <br /> <br />Asti-Caranci: <br /> <br />That wouldn't be true either, because part of the Use <br />Tax on auto goes to open space and the balance goes <br />to General Fund. <br /> <br />Griffiths: <br /> <br />Maybe, what we should say is that all of the revenues <br />from the Use Tax shall be deposited in such funds as <br />the Council should designate. <br /> <br />11 <br /> <br /> <br />
