Davidson called for Council's questions. <br /> <br />Sisk wondered who was paying for the Title Insurance policy. <br /> <br />Wood stated that the Planning Department would be. <br /> <br />Lathrop wondered who maintains the Public Service Company's easement that provides access to this <br />outlot. <br /> <br />Wood stated that the maintenance is the city's responsibility. <br /> <br />Sisk moved that Council approve the motion to accept the Warranty Deed of Outlot A from the <br />Summit Homeowner's Association to the City of Louisville. Seconded by Howard. Roll call was <br />taken. Motion passed by a 7 - 0 vote. <br /> <br />DISCUSSION/MOTION - ACKNOWLEDGE ACCEPTANCE OF A NEW ACCESS <br />EASEMENT BENEFITING LOTS 1 AND 3 OF THE COAL TRAIN SQUARE <br />SUBDIVISION <br /> <br />Paul Wood, Planning Director, stated that Lot 1 owner is Norwest Colorado Incorporated and Lot <br />3 owner is Carol Sorrell. He stated that the proposed action does not vacate any existing utility <br />easements. Staff did not intend to administratively amend the existing subdivision plat. If Council <br />accepts conveyance of the easements, staff will approve an administrative amendment to the Final <br />PUD Development. <br /> <br />Erik Hartronfi, Hartronfi Associates, stated that the only change they are proposing is to modifiy the <br />legal description for Easement B, to the south edge of Easement B, to accommodate the tree on the <br />north side of the road. <br /> <br />Davidson called for Council questions. <br /> <br />Sisk wondered why the original 45° easement was created. <br /> <br />Hartronfi stated that was part of the original PUD, 1982. <br /> <br />Lou DellaCava, 6238 Songbird Circle, Boulder, Colorado, stated that when Coal Train Square was <br />first approved in the early '80's, he did not feel at that time there was any specific intention to develop <br />anything but the lot where the Diamond Shamrock Station is. <br /> <br />Susan Griffiths, City Attorney, stated that there had been technical comments about the legal <br />description and she would be getting with Erik Hartronfi to work those out. <br /> <br /> <br />
