BACKGROUND: <br />The applicant requests a rear setback variance to allow for permitting of an existing <br />pergola on his property located at 749 Wildrose Way in the Centennial 4 subdivision. The <br />property is zoned Residential Estate (RE) and additionally governed by the Centennial 4 <br />planned unit development (PUD). <br />The applicant has already constructed the pergola and is now seeking an after -the -fact <br />variance to allow it to remain and be permitted. The pergola posts sit 2.5 feet from the rear <br />lot line and the rafters extend to one foot from rear lot line. Section 17.16.030 governs rear <br />setbacks of accessory structures and requires a minimum setback of 10 feet. The <br />applicant is requesting a variance of nine feet on the rear setback. <br />The pergola complies with side setback and other applicable regulations. The minimum <br />side setback per the Centennial 4 PUD is five feet, and section 17.16.050 of the LMC <br />allows eaves to extend up to three feet into setbacks. The posts for the pergola are five <br />feet from the south side lot line and the rafters extend to within two feet of the lot line, so <br />comply with regulations. <br />2 <br />
