Sisk stated that he and others had attended 1st Bank and Confidental's open houses recently for their
separate grand openings in Louisville. He congratulated the new businesses.

Howard attended the Seniors Advisory Board meeting. Under discussion was how Council handled
repayment of funds to the seniors when they commit to going on an outing, but are unable to follow
through. The Board suggested getting group insurance that they will pay for, so if people are not able
to meet their commitments, the city government does not have to pay the money for the seats for the
various events.

REGULAR BUSINESS

ORDINANCE NO. 1161, SERIES 1994 - VACATION OF A PORTION OF ABANDONED
ACME MINE SPUR RIGHT-OF-WAY EAST OF ROOSEVELT AVENUE, WEST OF MAIN
STREET - TRI-CITY ELKS - 2ND READING - PUBLIC HEARING - (PUBL. LSVL. TIMES
9/24/94)

Griffiths read by title only Ordinance No. 1161, Series 1994, "An ordinance vacating a portion of the
Acme Mine Spur located in the southeast 1/4 of Section 8, Township 1 South, Range 69 West of the
6th P.M. within the City of Louisville, Colorado."

Paul Wood, Planning Director, stated that this was requested by the Tri-City Elks and the adjoining
property owners to the south on Parkview Street to initiate a vacation of a portion of the Acme Mine
Spur, approximately a 6,500 s.f. parcel located between Roosevelt and Main Street between the Tri-
City Elks facility and the property owners to the south. The Ordinance was passed on first reading
conditional upon an agreement and the applicant and adjoining property owners, which provides a
30 day notice prior to the applicant or Tri-City Elks commencing construction improvement of the
parking lot. The second part of the agreement would be an agreement between the property owners,
the applicant, and the ditch company to not obstruct the ditch in any fashion. The document had not
been executed. All of the conditions of the Planning Commission had been met.

Howard called for the applicant's presentation.

Dave Wyman, Trustee, Tri-City Elks Lodge No. 2541, 525 Main Street, Louisville, Colorado, stated
that he had contacted Monroes and they'll be meeting tomorrow night at 7 p.m. He explained what
the city wanted and they verbally agreed. He stated that the only thing in the letter that Mr.
Mayhoffer might want would be a 10' fight-of-way for his ditch. Wyman felt they could all live with
that. He suggested that instead of redrafiing the letter, a note be put at the bottom of the letter that
that right-of-way will be agreed to.

Susan Griffiths, City Attorney, felt there would not be a problem with that.

Howard opened the public hearing calling for anyone wishing to speak on Ordinance No. 1161.
