Davidson closed the public hearing and called for Council comments, questions, or motions. <br /> <br />Howard moved that Council approve Ordinance No. 1169, Series 1994, on second and final reading <br />as amended. Seconded by Mayer. Roll call was taken. Motion passed by a 7 - 0 vote. <br /> <br />ORDINANCE NO. 1162, SERIES 1994 - (KNOLLWOOD ESTATES) COMMUNITY <br />DEVELOPMENT GROUP - AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL <br />CODE ENTITLED "ZONING" BY REZONING CERTAIN PROPERTY LOCATED <br />GENERAL1.Y SOUTH OF STATE HIGHWAY 42, WEST OF 104TH STREET, NORTH OF <br />CHERRY STREET, AND EAST OF THE BURLINGTON NORTHERN RAILROAD <br />TRACKS - 1ST READING (HAS BEEN ADVERTISED AS A PUBLIC HEARING <br />CONTINUED FROM 9/10/94) - SET PUBLIC HEARING 12/6/94 <br /> <br />Griffiths read by title only Ordinance No. 1162, Series 1994, "An ordinance amending Title 17 of the <br />Louisville Municipal Code entitled "Zoning" by rezoning certain property located generally south of <br />State Highway 42, west of 104th Street, north of Cherry Street, and east of Burlington Northern <br />Railroad tracks." <br /> <br />Paul Wood, Planning Director, stated that the General Development Plan defines approximately 170 <br />acres. The GDP would rezone approximately 119 acres from CB and Industrial to Planned <br />Community Zoned District - Residential (PCZD-R) and approximately 30 acres to PCZD-Open <br />Space. Approximately 20 acres, currently part of the Colorado Tech Center, and proposed to remain <br />in industrial use, will be rezoned to PCZD-Industrial. The Planning Commission held a public hearing <br />on August 18, 1994, and by a vote of 5 - 0, approved a motion disapproving: <br /> <br />1.) <br /> <br />A request to rezone approximately 170 acres from Industrial and Commercial <br />Business (CB) to Planned Community Zoned District (PCZD); <br />A General Development Plan Designating 119 acres - Planned Residential (P-R), 30 <br />acres - Planned Open Space (P-OS), and 20 acres - Planned Industrial (P-l). <br /> <br />Wood went on to summarize the information on Knollwood Estates (SEE ATTACHED). He stated <br />that staff recommended that the findings of the Planning Commission be upheld. Wood asked that <br />an October 28, 1994, letter addressing the rezoning from the applicant be entered into record (SEE <br />ATTACHED). Wood asked to have five letters entered into record: a letter from Horton Cavey <br />Realty Company dated September 30, 1994, signed by the partners in the Box Elder Investment <br />Company; a September 29, 1994, letter to the Louisville Planning Commission from Martin Schmitz; <br />an October 27, 1994, letter to the Louisville Planning Commission, attention to Paul Wood from Jim <br />D. Burton, B & S Investments; a November 1, 1994, letter to Mayor and Council from Bette Griff, <br />Biotrol International; and an undated letter to Mayor Davidson from Dick Ferguson; (included was <br />a letter from Herman B. Mitchell, Confi-dental Products Company). <br /> <br />Davidson entered these into record and called for the applicant's presentation. <br /> <br /> <br />
