City Council <br />Meeting Minutes <br />November 15, 2016 <br />Page 6 of 14 <br />originally platted in 1991 and is zoned commercial. There are existing structures on <br />each of the lots. The proposal is for a three-story, 56 -unit assisted living facility. The <br />replat combines two lots and establishes a drainage easement and a public access <br />easement. The application includes the preservation of the Hecla Mine historic element. <br />The applicant is requesting setback waivers for the parking setback, the side setback, <br />and an accessory structure setback. The architecture is a three-story building with a <br />courtyard and is a craftsman style building. The proposed structure is higher than the 35 <br />foot limit which requires a waiver. However, the buildings to the east are over 50 feet. <br />Staff finds this building to be an appropriate transition with the adjacent North End <br />residential neighborhood. <br />Landscaping screens the parking area, provides trail connections, and maintains the <br />existing cottonwood trees to be a buffer. There is a requirement tonight that the trees be <br />replaced when necessary to maintain the buffer. <br />The applicant made substantial changes from the original consideration at the Planning <br />Commission and at the second review by the Planning Commission it was unanimously <br />approved. <br />Since publication of the staff report, the applicant has changed this request to be for 58 <br />units but with no change in the footprint of the building, the overall site plan, or parking. <br />Staff recommends approval of the request with this change, with one condition that prior <br />to recordation of the PUD the applicant shall change the plan with the updated number <br />of units. <br />City Attorney Light, following up on Councilmember Maloney's earlier question, noted <br />the City Charter would not require recusal unless Councilmember Keany's spouse's <br />compensation or financial interest were directly affected by Council's action on this item. <br />Councilmember Keany stated that is not the case. <br />Dave Williams, DTJ Design 3101 Iris Street, Boulder, CO 80301, spoke for the applicant <br />noting Balfour's long history in the City of Louisville. He stated Balfour provides a full <br />spectrum of care in the facility. The proposed facility includes services and residences. <br />He noted the elevations of the building are inspired by the farm houses of Boulder <br />County. He stated the areas of the building that exceed the height limit are the gables <br />which fall back from the building. The only part of the building that hits 40 feet is one <br />small section. He noted the analysis shows that the impact to the adjacent open space <br />is minimal and the building does not shade the trails in the open space. He added this <br />building is shorter than the neighboring Balfour buildings. The building is tucked into the <br />trees and even in winter should be a small impact. He stated the applicant is committed <br />to enhancing the landscaping on the site to reduce the impact on the neighbors. <br />
