ORDINANCE NO. 1176, SERIES 1994 - VACATING A PORTION OF EAST STREET <br />LOCATED IN THE NORTHEAST 1/4 OF SECTION 17, TOWNSHIP 1 SOUTH, RANGE <br />69 WEST OF THE 6TH P.M. WITHIN THE CITY OF LOUISVILLE, COLORADO - L.F. <br />LYNCH AND JOHN QUINLAN - THE IN KEEPER SUBDIVISION - 1 ST READING - SET <br />PUBLIC HEARING 1/17/95 <br /> <br />Griffiths read by title only Ordinance No. 1176, Series 1994, "An ordinance vacating a portion of East <br />Street located in the northeast 1/4 of Section 17, Township 1 south, Range 69 west of the 6th P.M. <br />with the City of Louisville, Colorado." <br /> <br />Peter Kernkamp, Acting Planning Director, stated that the Olson Subdivision Plat originally showed <br />this street and three lots. Subsequently, the improvements were never completed, the street was <br />never constructed, and none of the public improvements had ever been made. The current owner <br />was seeking to consolidate and develop the property as a single parcel and had submitted a PUD <br />Development Plan for a mini storage facility. Planning Commission considered the PUD on <br />December 13, 1994, and approved the right-of-way vacation by a vote of 5 - 0 with the condition that <br />access for the Mayhoffer Trust be addressed prior to review by City Council. The Trust needed to <br />maintain access to some irrigation lateral headgates that are used on their property. Currently, the <br />access is occurring not on the location of this existing dedicated right-of-way, but on adjacent, city <br />owned open space to the east of the Olson Subdivision. There is a gas line easement along there, <br />which he felt would be an appropriate location to provide access for the Mayhoffer Trust. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />NONE <br /> <br />Davidson called for Council comments, questions, or motions. <br /> <br />Davidson asked, since this land was in the area where Louisville could connect with 96th Street with <br />Hwy. 42, should the city be looking for any easement to connect between Hwy. 42 and 96th Street <br />in exchange. <br /> <br />Tom Phare, Public Works Director, stated that that involves Cherry Street not East Street. <br /> <br />Mayer was concerned that the city was giving away something for nothing. He wondered if a trade <br />would be possible for the city in other areas, where it would be some benefit to the city. <br /> <br />Phare offered to look into that. <br /> <br />Larry Lynch, 7923 Crestview Drive, Boulder, Colorado, stated that 10 years ago when Mr. Olson <br />was first looking at this property, there was an exchange of 16 acres of land that is now the current <br />open space property to the east to help the realignment of 96th Street. <br /> <br />10 <br /> <br /> <br />
