Superior as it may exist from time to time. The <br />question that came up was, "How do we know the Coal <br />Creek Basin drainage area?" The Town of Superior <br />offered to provide a legal description, that was provided <br />to the City at 4:00 p.m. today. It has not been reviewed <br />in detail by the Public Works Director. If the Council <br />has a desire to proceed with the resolution this evening <br />and if you have a desire to approve the agreement, you <br />could do so subject to review of Exhibit No. 1 by the <br />Public Works Director and an assurance on his part that <br />the legal description accurately represents the Coal <br />Creek Basin Drainage area that the parties intended. <br /> <br />Davidson: <br /> <br />I would like to congratulate the City Administrator, City <br />Attorney and the City staff that worked on this <br />agreement. It has been a point of contingent between <br />Superior and Louisville for over two years in providing <br />a description of Coal Creek Basin. I am glad to see us <br />moving forward and getting along with our neighbors. <br /> <br />Sackett moved that Council adopt Resolution No. 6, Series 1992, thereby, rescinding the <br />1982 Water Agreement with Superior; rescinding the 1982 Sewer Agreement with Superior <br />and replacing it with the new sewer agreement; and directing the City Attorney to take all <br />action necessary or appropriate for dismissal with prejudice, each party to bear its own cost <br />in attorney fees of the case of Town of Superior, Colorado vs City of Louisville, Colorado, <br />et al., Colorado Court of Appeals Case No. 90CA1443 and Boulder District Court Civil <br />Action No. 89CV587, subject to the Board of Trustees of Superior approving the <br />agreements and directing their town attorney to take similar action; and subject to approval <br />by City staff of Exhibit 1 to the Sewer Agreement, seconded by Fauson. Roll call was <br />taken. Motion passed 6-0. <br /> <br />ORDINANCE NO. 1064, SERIES 1992 - SEWER RATES FOR TOWN OF SUPERIOR, <br />COLORADO - 1ST READING - SET PUBLIC HEARING <br /> <br />Griffiths read by title only Ordinance No. 1064, Series 1992, "An ordinance regarding sewer <br />rates for the Town of Superior, Colorado." <br /> <br />Griffiths explained to Council that as a follow-up to the previous action that one of the <br />necessary actions for Council is to insure that the City ordinances conform to the <br />agreement with the Town of Superior. Ordinance No. 1064 clarifies that the sewer rates <br />to be charged to the Town of Superior are to be established in accordance with the <br />agreement previously approved. <br /> <br />Fauson moved that Council place Ordinance No. 1064, Series 1992 out for publication and <br /> <br />5 <br /> <br /> <br />
