All in favor. <br /> <br />ORDINANCE NO. 1063, SERIES 1992 - RlgLINQUISHING UTILITY EASEMENT - <br />FERRERA - 1ST READING - SET PUBLIC HEARING <br /> <br />Griffiths read by title only Ordinance No. 1063, Series 1992, "An ordinance transferring <br />by Quick Claim Deed any title and interest of the City of Louisville in an easement." <br /> <br />John Franklin, Director of Community Development, informed Council that information <br />was available in their packet and would hold his presentation until the public hearing but <br />he was available to answer any questions at this time. <br /> <br />Howard moved that Council place Ordinance No. 1063, Series 1992 out for publication and <br />set a public hearing for January 21, 1992, seconded by Sackett. All in favor. <br /> <br />RESOLUTION NO. 1, SERIES 1992 - AMENDMENT TO FINAL PUD DEVELOPMENT <br />PLAN SADDLEBACK, SECOND FILING (SADDLEBACK II) <br /> <br />Councilman Howard excused himself from participating in the discussion. Howard resides <br />in Saddleback. <br /> <br />John Franklin, Director of Community Development, explained that before Council is a <br />request by two property owners in Saddleback II Subdivision. The request is for approval <br />of an amendment to the Saddleback Final PUD Development Plan. The amendment will <br />permit extension of the existing 6' shadow-box-style privacy fence along Tyler Avenue right- <br />of-way in back of Lots 14, 15 and a portion of Lot 16 to the private open space area. The <br />PUD plan presently requires the three lots to install a 48" split rail fence against Tyler Ave. <br />The owners wish to continue the existing fence design and to enjoy additional privacy from <br />the street. At present the standard evidenced by the Final Development as recorded for <br />these lots requires a California style chain link or split rail. Planning Commission did <br />review the request and recommended approval to Council. Franklin called from the staff <br />memorandum that typically in terms of fence standards when it is open space the City <br />requires an open fence, chain link or split rail. However, when it is abutting a street right- <br />of-way the City typically allows a privacy fence. <br /> <br />Davidson moved that Council adopt Resolution No. 1, seconded by Fauson. Roll call was <br />taken. Motion passed 5-0 with Councilman Howard excused from discussion and voting. <br /> <br />WATER SERVICE TO PROPERTY OF I.,ARRY AND MARTHA HELMS <br /> <br />Susan Griffiths, City Attorney, commented on the January 2, 1992 memorandum to Council <br />regarding the request of Lanny and Martha Helms. The Helms have requested water <br />service to their property which is located outside-City limits of Louisville. The Helms <br />prefer not to annex or agree to annex the property to the City.
