That would probably be one <br />last bill from Rocky Mountain <br />Consultants? <br /> <br />Phare: <br /> <br />There are some other bills in <br />process. <br /> <br />Sisk: <br /> <br />Do you have an estimate of what <br />those bills would be? <br /> <br />Phare: <br /> <br />I believe they're in the $30 - <br />40,000 range. <br /> <br />Sisk: <br /> <br />Susan, would you contact the law <br />firm bonding Council and see what <br />their position would be on the <br />question of work that has not been <br />billed but, in fact, was performed <br />prior to this date? <br /> <br />Griffiths: <br /> <br />Yes. I, also, spoke with Mr. <br />Falacienski about the $180,053.00 <br />that was previously expended and he <br />said that even though the specific <br />resolution would not effect that, <br />if there was objective evidence at <br />the time of that expenditure, that <br />the issue expected to reimburse the <br />expenditure with the proceeds of the <br />borrowing, might be available for <br />reimbursement. We would have to <br />look at the evidence at that time. <br /> <br />Sisk: <br /> <br />I don't want to concede the <br />$180,053.00. <br /> <br />Howard moved that Council adopt Resolution 8, Series 1992 with the <br />caveat that the City Attorney look into the reimbursement issue of <br />$180,053.00, seconded by Mayer. <br /> <br />Lathrop: <br /> <br />Councilman Sisk, would the motion <br />adequately protect us if, in fact, <br />we could include the $180,053.007 <br /> <br />Sisk: <br /> <br />I would like wide latitude for not <br />only the $180,053.00 but also the <br />$30,000.00 or so that has been <br />billed. I would hope the resolution <br />could be done in such a way that we <br />could get the $210,000.00 back as <br />part of the bond proceeds. <br /> <br />18 <br /> <br /> <br />
