Asti-Caranci:

Right. That would probably be one
last bill from Rocky Mountain
Consultants?

Phare:

There are some other bills in
process.

Sisk:

Do you have an estimate of what
those bills would be?

Phare:

I believe they're in the $30 -
40,000 range.

Sisk:

Susan, would you contact the law
firm bonding Council and see what
their position would be on the
question of work that has not been
billed but, in fact, was performed
prior to this date?

Griffiths:

Yes. I, also, spoke with Mr.
Falacienski about the $180,053.00
that was previously expended and he
said that even though the specific
resolution would not effect that,
if there was objective evidence at
the time of that expenditure, that
the issue expected to reimburse the
expenditure with the proceeds of the
borrowing, might be available for
reimbursement. We would have to
look at the evidence at that time.

Sisk:

I don't want to concede the
$180,053.00.

Howard moved that Council adopt Resolution 8, Series 1992 with the
caveat that the City Attorney look into the reimbursement issue of
$180,053.00, seconded by Mayer.

Lathrop:

Councilman Sisk, would the motion
adequately protect us if, in fact,
we could include the $180,053.007

Sisk:

I would like wide latitude for not
only the $180,053.00 but also the
$30,000.00 or so that has been
billed. I would hope the resolution
could be done in such a way that we
could get the $210,000.00 back as
part of the bond proceeds.

18
