Lathrop:

Griffiths:

Susan, in your opinion, would the
motion stated be adequate to protect
us should it be found that we could
get reimbursement?

At this point, you should go ahead
and adopt Resolution 8, Series 1992
so that we would be clearly
protected with respect to the
$163,000. If there is any further
action that we could take that would
be of assistance in protecting us
with respect to any other funds, we
could bring that back to you at the
next Council meeting for action at
that time.

Sisk:

I would like to see a resolution
that complies with the attorney, Mr.
Falochinsky's letter so we can be
clearly on record that the
resolution ~contemplates that these
monies were expended in anticipation
of the acquisition of the Water
Treatment plant. I would like to
have that on the February 4, 1992
Agenda.

Howard:

Is that an Amendment?

Sisk: Yes.

Howard:

Then, somebody has to second it.

Seconded by Lathrop. It is bordered by
McCaslin Blvd. on the west and completely bordered by houses on all
the other sides. In Phase I; on the west side, the City did some
berming; tree and shrub planting along with some drip irrigation;
and wild flowers. In Phase II; more tree planting along the
outlet; some drip irrigation; a handicap accessible path; and a
soft surface trail around the perimeter of the Wildlife Sanctuary
itself. There is $65,000.00 allocated in the 1992 Capital Budget
from the proceeds of our Conservation Trust Fund (Lottery
proceeds). In 1990, we began improvements at Harper Lake Wildlife
Sanctuary and, at that time, it was proposed to be a four phased

19
