give up the land and set a precedent for outlots and other sub- <br />divisions being relinquished over a maintenance issue; two, the <br />City Council should explore other options such as License <br />Agreements which convey opportunities for use and enjoyment. <br /> <br />Dave Rhodes, Coal Creek Associates, 1400-28th Street, Boulder, CO. <br /> <br />Rhodes: <br /> <br />Last summer when we began to <br />organize to get this area into its <br />native seed as per the PUD, we were <br />approached by several of the owners <br />who had requested that it be a <br />higher level of landscaping than the <br />PUD called for. The Parks <br />Department didn't feel they could <br />afford the time and effort to <br />maintain an irrigated sodded area. <br />We tried to reach a compromise, <br />where the home owners would be <br />deeded back a portion of the outlot <br />and they would maintain the it. We <br />are here at the request of the home <br />owners with the replat, trying to <br />accomplish that. The replat <br />represents a six foot public area <br />that will go through the outlot. <br />The remaining area is going to <br />private ownership of the adjacent <br />home owners on a continuation of <br />their lot line. The entire existing <br />outlot would remain as a drainage <br />and utility easement for the City to <br />be able to get in there. There are <br />several areas within Coal Creek now, <br />where we do have storm sewer lines <br />going through private lots. The <br />plan is for a decorative not an <br />obstructive type of landscaping. <br />Deed restrictions could be placed on <br />the lots for fencing and landscape <br />replacement. <br /> <br />Davidson called for Council comments or questions. <br /> <br />Mayer: <br /> <br />I am concerned that this is public <br />land. I would prefer that Council <br />examine other avenues of meeting the <br />home owners' needs.
