I, also, have <br />this letter from John Franklin <br />saying there is no problem. <br /> <br />It's clear to me that the Heritage <br />II Subdivision contemplated an <br />easement for a driveway. It's clear <br />to me that Sundance II PUD indicates <br />an access for a driveway and I have <br />no reason to believe that the <br />unrecorded easement before me is not <br />a genuine document. I have trouble <br />with automobiles, UPS trucks, trash <br />trucks, and normal traffic crossing <br />a fairly heavily used bike path. <br />Council could acquire the property <br />as open space, deny the request <br />based on potential safety hazards, <br />or approve with the property owner <br />agreeing to: one; use an alternate <br />access if and when provided from the <br />Waremberg property, two; agree to <br />the property as a single family <br />dwelling only, three; agree to <br />separate the driveway and the bike <br />pedestrian path off of Sycamore. <br />Also, agree to widen the bridge. <br /> <br />We have agreed with the <br />Marshall to widen the bridge. <br /> <br />Fire <br /> <br />Former Councilwoman Morris stated <br />that the original intention of <br />Council then that the access <br />easement was not to go over to <br />Sycamore, but was going to go down <br />to Buchannan or Hackberry. Ms. <br />Morris's recollection was that it <br />was Council's intent that Mr. <br />Houseman work out with American Home <br />Builders, who she thought was <br />developing that property, to gain <br />the easement. It was never the <br />intention of the 1984 Council to <br />have an easement through the <br />publicly dedicated bike path. There <br />is a lot of murkiness in all of this <br />and I would have trouble <br />recommending both a bike path and a <br />driveway there. I did suggest <br /> <br />22 <br /> <br /> <br />
