Fraker: That's correct.

Mayer:

Fraker:

The detention pond in land
underneath the power poles is not
part of any open space dedication to
the City.

That's correct.

Mayer:

If it comes down to a PUD process,
Council needs to explore how to
handle the situation with the
already zoned commercial land. My
concern is homeowners coming back to
Council several years later saying,
"There's a huge parking lot there
with these light structures shining
into our yards."

Fraker:

We received that same comment from
the Planning Commission. Since then
we have met with our neighbors,
gotten some basic ideas, and are
pursuing that in a most vigorous
manner.

Sisk:

Mr. Fraker, has the issue of the gas
well been totally resolved? Will
that be deleted then?

Fraker:

Sisk:

The gas well will be deleted and the
well itself will go away. We are in
final negotiations on that process.

Will there be a clearance received
from the EPA or from anyone
regarding the property that could
have been polluted by the gas well?

Fraker:

I don't believe I'm qualified to
answer that. We are looking into
it. Our first issue has been to
negotiate the purchase of the gas
well and the rights underneath it.
We will have that resolved or have
some definitive answers for Council
when we come before you on June 2.

Sisk:

And on that date you would have a
specific proposal on the "cash in
lieu of" for Council on the open
space issue?

5
