Howard:

From your maps it does look like you
have reasonable coverage except for
new areas across Via Appia. Is
there any additional information on
the new areas or if this is the area
of coverage?

Scott:

Are you in the area across from the
new Recreation Center?

Howard:

Near there.

Scott:

I apologize. That isn't on our
mapping materials. I can tell you
that in our experience you usually
get the most conservative results
from the applicants standpoint in
and around the site location, which
we were very careful to hit very
thoroughly. That way people would
have an understanding as to what was
happening in the neighborhood. I
don't think that the results would
be substantially different at all.

Mayer:

To the City Attorney. In response
to Mr. Fyne's comment, is the
presence of the applicant's attorney
here, giving advice a possible
problem with regard to the Ethics
Code?

Griffiths:

Ail I can say is that is a decision
being made by the attorney. Whether
or not the attorney wishes to risk
violation of the Ethics Code. My
understanding of it was that he
decided not to actively participate
in the Hearing. The question being
raised here is whether he is
participating by sitting in
proximity to the witnesses and Mr.
Scott. Again, that's a risk that
he's taking.

Howard:

In our counsel's opinion would the
seeming conversations that the
attorney is having with the client
be in your judgement considered
participation?

Griffiths:

I would prefer not to respond to

27
