Whether <br />or not the attorney wishes to risk <br />violation of the Ethics Code. My <br />understanding of it was that he <br />decided not to actively participate <br />in the Hearing. The question being <br />raised here is whether he is <br />participating by sitting in <br />proximity to the witnesses and Mr. <br />Scott.
