Mayer:

is provision and specific exhibits
for performance guarantee. There
are also clauses in the standard
Subdivision Agreement regarding
completion requirements, dates for
completion of certain Phases, and
penalty provisions cited in the
standard Subdivision Agreement.
Before the Developer can proceed
with the development of the
property, that Agreement must be
completed, executed, and approved.

It seems to me that the Coal Creek
Trail is more of an after thought
than something that is integrated
into the project. I recall that the
City was in the process of looking
at the Golf Course Annexation and
development. They had considered
with the County initially a route
that went up by the creek. As the
Golf Course concept matured and
gained detail there was a growing
concern about golf balls,
liability, folk coming by the Golf
Course, through the Golf Course, and
golfers interacting with the general
public in an semi-uncontrolled
setting. That apparently generated
the development plan which rerouted
the alignment away from the Golf
Course. One alignment was the gas
line. I wasn't with the City at
that time, but the City was working
on both the Golf Course and the
trail concept and they were very
concerned about golf balls hitting
people, etc.

Mayer:

I have a concern about cars hitting
people and some of the street
standards here. In going to Coal
Creek to look at another issue
having to do with the sale of Open
Space, I observed several problems

17
