to dedicate to the City the portions <br />to be used as open space areas as <br />illustrated on the preliminary plat <br />of the entire subject area upon <br />approval of the final plat of the <br />first filing of the annexed <br />territory. As I read this, it <br />appears to me that the open space <br />dedication for the entire area, <br />including Hillsborough West and what <br />has become known as Ridgeview <br />Estates, was to have been dedicated <br />at the time of the final plat of <br />Hillsborough West. <br /> <br />Hornbostel: <br /> <br />When they did their first <br />preliminary filing it wasn't acted <br />upon within the year, so I was <br />wondering whether that open space <br />dedication still held up, if there <br />was any kind of limitation or <br />statute of limitations? <br /> <br />Griffiths: <br /> <br />I don't view the link between the <br />original preliminary plat and the <br />open space dedication as being <br />linked together. What was linked <br />was that the dedication for the <br />entire area was to have been <br />completed by the time the <br />Hillsborough West final plat was <br />approved. <br /> <br />Swede Johnson, Chris9~ Bynum & Johnson, stated that he had <br />researched it and he agrees with Griffiths' interpretations. At <br />the time of the annexations the parameters were given and the <br />requirements were to be met at the time, no later than the first <br />filing of the first subdivision. He stated that at the time, money <br />in lieu of land was dedicated, water rights were turned over, and <br />that was for the entire area, which included this land. All of the <br />requirements for the entire tract were met at that time and the <br />City received certain water rights, land, fees, and a variety of <br />other things. <br /> <br />Howard: <br /> <br />You're going to be moving <br />substantial quantities of soil.
