to dedicate to the City the portions to be used as open space areas as illustrated on the preliminary plat of the entire subject area upon approval of the final plat of the first filing of the annexed territory. As I read this, it appears to me that the open space dedication for the entire area, including Hillsborough West and what has become known as Ridgeview Estates, was to have been dedicated at the time of the final plat of Hillsborough West. Hornbostel: When they did their first preliminary filing it wasn't acted upon within the year, so I was wondering whether that open space dedication still held up, if there was any kind of limitation or statute of limitations? Griffiths: I don't view the link between the original preliminary plat and the open space dedication as being linked together. What was linked was that the dedication for the entire area was to have been completed by the time the Hillsborough West final plat was approved. Swede Johnson, Chris9~ Bynum & Johnson, stated that he had researched it and he agrees with Griffiths' interpretations. At the time of the annexations the parameters were given and the requirements were to be met at the time, no later than the first filing of the first subdivision. He stated that at the time, money in lieu of land was dedicated, water rights were turned over, and that was for the entire area, which included this land. All of the requirements for the entire tract were met at that time and the City received certain water rights, land, fees, and a variety of other things. Howard: You're going to be moving substantial quantities of soil. On a slope like this that translates into extraordinary means for ensuring that the sediment does not go downstream. Have you computed a value of how much silt can be normally expected from that type of 27
