Also, I'm <br />still not clear on this thing with <br />the open space dedication, because <br />in the subdivision annexation <br />agreement it says that open space <br />dedications are to made at the time <br />of subdivision approval. <br /> <br />There is an exception to that. In <br />Section 16.16.060-B4 of the <br />Municipal Code, which is part of the <br />public site and dedication <br />requirements, it says that the <br />requirements of this section shall <br />not apply in cases where <br />satisfactory dedication arrangements <br />were made and approved by the City <br />Council at the time of annexation or <br />previous subdivision of the same <br />property. The argument in this case <br />is that the open space dedications <br />were made either at the time of <br />annexation or, my recollection is, <br />they were completed at the time of <br />the final plat approval of the <br />Hillsborough West subdivision. In <br />theory, all of the open space <br />dedications were completed at that <br />time.
