Unusual circumstances based on lot topography <br />do not exist. <br />iv. With the 2011 addition and an addition of a second story deck has, and <br />will further affect the value of my property. I have been at this location since <br />1993. Before the addition I was able to use my backyard and was afforded a <br />certain amount of privacy based on the fact that the house had not been <br />added to and did not restrict me from using my yard. The fence was enough <br />to give each house privacy. I stopped using my backyard because of lack of <br />privacy when the addition went in. To further complicate this issue, the <br />addition of a deck and stairs will absolutely restrict my use of my backyard <br />because (as mentioned earlier) I am at a lower elevation and they are <br />basically on top of me, towering above me. Not to mention that they will be <br />having their parties and eating out on the deck, which, as you can see from <br />the photos, is at the level of my bedroom and in very close proximity. I will be <br />unable to keep my blinds open in the bedroom at anytime of year and will <br />not be able to allow for fresh air to circulate in my upstairs bedroom because <br />I will need to keep the blinds down because of a direct view if me on my <br />bed. Lights and noise from the use of the deck will be a sleeping problem. <br />From the first level I will be subjected to noise and lack of privacy as their <br />home addition and deck addition are above the privacy fence level, making <br />everything thing in view. Our two houses are the closest together in the <br />neighborhood. They will further complicated this matter with the addition of <br />the deck. This will devalue my investment as potential buyers will be turned <br />off by the stunning lack of privacy. <br />v. Modifications have already been afforded this home with the 2011 <br />addition. They have access to their backyard via the lower level out onto the <br />patio (lighted that is, that shines in my eyes all night when they forget to turn <br />them off). I do not believe, given the close proximity of the two houses, the <br />elevation difference and the fact that they are almost at the maximum lot <br />coverage now that it is reasonable to add onto the house more. <br />
