Wood:

A phasing line can be shown on the
subdivision plat. The actual
phasing plan can be incorporated in
the subdivision agreement.

Mayer:

Exactly how much extra land is the
City getting?

Wood:

Outlot A is approximately 2.9 acres.
We would have to net that out of the
right-of-way for Ridgeview Drive and
the two lots that we will be
conveying back.

Mayer:

So, actually the City is gaining
over two acres. Also, I would ask
Council to support the phasing as
part of this resolution, going with
10 C.O.'s per quarter, beginning in
the fall of '93.

Davidson:

I hope I didn't give anybody at the
meeting at the Recreation Center the
idea that this particular
development was a foregone
conclusion. I specifically said
that I wasn't there to sell this
development. I did try to tell the
people the legal aspects the City is
in. The land is annexed and zoned
and therefore, there are certain use
by rights. That zoning would allow
for some 80 homes to be built on
there. Louisville is the only City
doing anything to address the
overcrowding by requiring phasing.
We're real sympathetic, but there is
not too much we can do other than
what we've already done.

Lathrop moved that Council approve Resolution No. 73, Series 1992,
a resolution approving a final subdivision Plat for Ridgeview
Estates and including Condition No. 11, to be added to the
Subdivision Agreement, which shall include a phasing plan, of which
the rate of development as measured by C.O.'s issued shall not
exceed 10 per quarter commencing with the second and third quarter
of 1993 combined and 10 C.O.'s per subsequent quarter.

Sheffield:

Mr. Mayor, if we don't achieve 10
C.O.'s in a quarter, if that could
possibly be carried over?

13
