EXHIBIT D <br />Work in Easement Area Guidelines <br />1. Timing and Regulations. Except as expressly prescribed otherwise in this Easement, Grantee <br />shall otherwise abide by the Rules and Regulations for Boulder County Parks and Open <br />Space Areas (located at www.bouldercounty.org/doc/parks/posrulesregs.pdf). <br />2. Access Routes and Use of Roads. Any and all access to and across the Easement Area shall <br />be along existing roads or trails and use them only under dry conditions, unless the County <br />provides written consent to alternative access. Grantee shall not grade or otherwise improve <br />any portion of the Open Space, including any existing roads. Grantee shall maintain the pre- <br />existing condition of any existing access roads to the Easement Area and shall repair any <br />wear and tear or damage Grantee causes to said roads at the end of the project and also <br />during the project if County so directs. <br />3. Notification and Ongoing Communication. At least three weeks prior to Grantee's initial <br />entry upon the Easement Property, Grantee shall contact Boulder County Parks and Open <br />Agricultural Resource Specialist Rob Alexander ("County's Primary Contact") at (303) <br />678-6239 to provide contact information for Grantee's work crews, schedule an on-site <br />preconstruction meeting, and to begin ongoing conversations with them throughout the <br />project to ensure soil conditions are appropriate for work, the County's agricultural tenant <br />receives advance notice, and that work is done in a manner that minimizes impacts to natural <br />resources, wildlife resources and historic or cultural resources. <br />4. Work Requirements to Minimize Damage. To protect all resources of the Easement Area, <br />Open Space and neighboring properties, Grantee shall comply with the following: <br />a) Property Specific Requirements: <br />1) Grantee will coordinate with Primary Contact to address property specific <br />considerations regarding the easement area, property and agricultural tenant <br />operations one month before construction begins. <br />b) Standard Requirements for Work in Easement Area: <br />1) Work Only in Dry Weather. Grantee shall obtain County's confirmation that weather <br />conditions and the ground are both dry enough for work that day so as not to create <br />ruts under the weight of Grantee's trucks and equipment. <br />2) Work Only in Easement Area. Other than expressly provided for herein, Grantee shall <br />not move or physically alter any portion of the Open Space outside of the Easement <br />Area. The width and scope of any disturbance shall be kept to an absolute minimum <br />within the Easement Area. Absolutely no disturbance shall be allowed outside the <br />Easement Area (including storage and operation of construction equipment and/or <br />Callahan Open Space Access and Utility Easement 13 <br />
