materials). <br />3) Fence Easement Area. Prior to commencing work, Grantee shall fence the Easement <br />Area using standard temporary construction fencing and shall post signage closing <br />access to the Easement Area. Also prior to commencing work, Grantee shall work <br />with the County's Arborist, whose contact information is listed above, to fence any <br />important trees out of the work area. Grantee shall remove all fencing, flagging and <br />markers after construction is completed, but not prior to County's post -construction <br />inspection and approval of all required restoration and reclamation. <br />4) Avoid Damage to Agricultural Uses. Grantee shall avoid damaging crops, livestock <br />and drain tiles or interfering with County's or its tenant's irrigation, <br />herbicide/insecticide applications and other agricultural activities on the Open Space. <br />County will inform the County's tenant of the work Grantee will be performing. <br />Grantee shall leave all gates in their open or closed position in accordance with how <br />Grantee finds them. If Grantee's use of the Easement Area causes any damage to the <br />Easement Area or Open Space, Grantee shall compensate the agricultural tenant <br />and/or County for any damage to crops, livestock, drain tiles or any other agricultural <br />resource and shall also restore the land, including, but not limited to, reseeding with <br />appropriate seed mix, as specified by County, to a condition substantially similar to <br />its condition at the signing of this Easement and to County's sole satisfaction, unless <br />County requests that the area be left as is. <br />5) Protect Historical and Cultural Resources. Grantee agrees to protect any historical or <br />cultural resources of the Easement Area, Open Space and neighboring properties, if <br />Grantee discovers anything that is potentially an historical or cultural resource, <br />Grantee shall immediately cease all activities until County's authorizes continuance. <br />6) Obtain Advance Approval for Excavations and Borings. Excavations, including <br />geotechnical boring locations outside of the Easement Area, must be individually <br />approved m advance by the County. <br />7) Disturb Land Carefully and Restore Fully. In the event any surface disturbance of the <br />Easement Area by Grantee is authorized under this Easement, Grantee shall carefully <br />disturb land within the Easement Area and no other area on the Open Space and shall <br />later restore all damaged land in accordance with the Reclamation Plan attached to <br />this Easement as Exhibit C. Grantee shall be liable and responsible for all damage to <br />or destruction of the Open Space, Easement Area or any improvements and natural <br />features located thereon, including, but not limited to, tire ruts, fencing, survey <br />monumentation, ditches and laterals, fencing, trees, shrubs, ground cover, and crops, <br />caused by, related to, or arising out of, Grantee's exercise of the rights under this <br />Easement. Grantee shall compensate Grantor for any damage and shall also restore <br />the land, including, but not limited to, reseeding with appropriate seed mix, as <br />specified by Grantor, to a condition substantially similar to its condition at the signing <br />of this Easement and to Grantor's sole satisfaction, unless Grantor requests that the <br />Callahan Open Space Access and Utility Easement 14 <br />
