Louisville City Council Meeting <br />January 6, 2004 <br />Page 6 of 12 <br /> <br />category for a proposed development subject to a fee. It is anticipated that such <br />determinations will need to be made in cases of mixed-use developments, core-and-shell <br />permit applications, and similar cases. She introduced Chris Duerkson, Managing <br />Partner for Clarion & Associates, consulting firm for the project. <br /> <br />Mayor Davidson opened the public hearing. <br /> <br />Jon Lee, 2500 Arapahoe, Boulder, CO, representing Colorado Tec Land, acknowledged <br />working with Staff, Council members and other parties. He stated there are still flaws in <br />the methodology of the ordinance. He addressed the grouping of services such as police <br />and transportation and felt the focus was too broad. With regard to the issue of sales tax <br />generation, he voiced his belief the additional fees would be detrimental. He explained <br />the designation of CTC is Industrial/Commercial and stated CTC is a Business Park. He <br />felt the designation of Business Park was more appropriate. <br /> <br />Terry O'Connor, 1014 Kalmia, Boulder, CO, emphasized the CTC development has <br />always paid its own way. He noted CTC is one of Louisville's largest job centers. He <br />explained when the City requested streetlights and sidewalks, CTC complied and paid for <br />those improvements. He distributed a chart, which compared the fees in other <br />communities and noted Lafayette, Superior, Broomfield and Boulder have lower fees <br />than Louisville. He asked Council to consider that CTC is in an extremely competitive <br />market. <br /> <br />COUNCIL QUESTIONS <br /> <br />Mayor Pro Tem Sisk stated his understanding that Mr. Lee served on the review <br />committee for some time. He asked Lee why he presented his letter of concern at such a <br />late date. Lee stated the consultant (Chip King) which was hired by several business <br />owners, had not received the information he requested. <br /> <br />Mayor Pro Tem Sisk asked Mr. Lee if his concern centered on the Planning Director <br />determination of the applicable fee category for a proposed development. Lee stated <br />centered on the definition of the type of development. <br /> <br />Mayor Pro Tem Sisk asked Mr. Duerkson to introduce himself. <br /> <br />Chris Duerkson, Managing Director for Clarion Associates, consultants on this impact <br />fee study. Duerkson stated he has worked closely with the City Attorney in the drafting <br />of the ordinance and with Consultant Paul Tishler, who did the actual analysis. <br /> <br />Mayor Pro Tem Sisk asked Mr. Duerkson to respond to the concerns voiced by Mr. Lee <br />and Mr. O'Connor. Duerkson stated he worked with Consultant Paul Tishler, who did the <br />analysis for the impact fees, and with Mr. Lee and Mr. O'Connor in this process. He <br />addressed the concern that the methodology is insufficient under Colorado law and stated <br />the same methodology used by Mr. Tishler has been used in other municipalities <br /> <br /> <br />
