Prior to acceptance of constructed improvements for the site, a 4 -foot maintenance <br />easement for the sidewalk adjacent to the west right-of-way line of Dogwood Street shall <br />be recorded. <br />2. Prior to City Council approval, the plans shall be revised to demonstrate compliance with <br />the turning radii requirements of the Louisville Fire Protection District (LFPD). <br />3. Prior to acceptance of constructed improvements for the site, an easement for access <br />and maintenance of the drainage easement area along the western edge of the property <br />shall be recorded. <br />Commission Questions of Staff:: <br />Moline asks when the applicant completes Phase II, will they be asked to install landscape <br />islands or will they be exempt in perpetuity. <br />Dean says the applicant is asking for the waiver in perpetuity. <br />Moline asks Dean to describe the retaining walls. <br />Dean says the diagram in IDDSG shows insets in the wall. She assumes there will be <br />landscaping in the insets. It will not be a flat, straight wall. <br />Moline asks if Public Works was okay with the modification of the retaining wall. Dean says yes. <br />Hsu says regarding the retaining wall, it says it is approximately 430' long and a maximum of <br />3.9' high. Is that a constant north to south? Dean says the applicant can answer that. <br />Rice asks regarding the retaining wall, given the space restraints coupled with the drainage <br />easement, are there alternatives? Would they have to cut into the parking lot? <br />Dean says it would affect overall site design and circulation through the site. This allows them to <br />most efficiently use the site. I don't think this building is too large for the site. They are proposing <br />flex use. They want to make sure trucks can get in and turn around. <br />Pritchard says doesn't a retaining wall over 36" required to have fencing. <br />Dean says they are required to have a handrail. <br />Zuccaro says the applicants can confirm whether this is on the plans. There is some distinction <br />in the Building Code if there is an adjacent pedestrian way.
