Local Licensing Authority <br />Minutes <br />May 22, 2017 <br />Page6of7 <br />MOTION: Machado moved sufficient evidence has been presented to support the <br />following charges stated in the Show Cause Order: <br />A. Louisville Municipal Code § 9.22.050, stating that any licensee shall <br />immediately report to the City police department any unlawful or disorderly <br />act, conduct, or disturbance committed on the premises. <br />and that the Authority Attorney be directed to prepare a draft of final findings, <br />conclusions and an order for consideration at the Authority's next meeting to be <br />held on June 26, 2017 and further moved to continue this matter until that time. <br />Hervey seconded. <br />Special Prosecutor Gollin reviewed the history of Henry's police contacts, letters <br />from the Authority and suggested the establishment serve days of active <br />suspension. <br />Authority members discussed the suspension, possibility of fine in lieu and how <br />to proceed. <br />VOTE: Roll Call Vote on motion: Hervey — yes, Lipton — yes, Tennessen — yes, <br />Carlson — yes and Machado — yes. <br />Authority members discussed a 4 day suspension on the first violation and 7 day <br />suspension on the second violation for preparing the findings and order. There <br />was a suggestion the employees be required to attend seller/server training. <br />Special Prosecutor Gollin suggested 3 days suspension for the first offense, on <br />the second offense 14 days suspension with 7 held in abeyance and the <br />condition all employees attend training. <br />Authority members gave final direction to the Authority Attorney to prepare the <br />findings and order with 4 days suspension for the first violation and 10 days for <br />the second violation. <br />Authority members thanked Special Prosecutor Gollin. <br />F. Conversation with Chief Hayes <br />Chief Hayes noted he and Sergeant Redard have discussed getting reports to <br />the Authority in a timely manner.
