Local Licensing Authority Minutes May 22, 2017 Page6of7 MOTION: Machado moved sufficient evidence has been presented to support the following charges stated in the Show Cause Order: A. Louisville Municipal Code § 9.22.050, stating that any licensee shall immediately report to the City police department any unlawful or disorderly act, conduct, or disturbance committed on the premises. and that the Authority Attorney be directed to prepare a draft of final findings, conclusions and an order for consideration at the Authority's next meeting to be held on June 26, 2017 and further moved to continue this matter until that time. Hervey seconded. Special Prosecutor Gollin reviewed the history of Henry's police contacts, letters from the Authority and suggested the establishment serve days of active suspension. Authority members discussed the suspension, possibility of fine in lieu and how to proceed. VOTE: Roll Call Vote on motion: Hervey — yes, Lipton — yes, Tennessen — yes, Carlson — yes and Machado — yes. Authority members discussed a 4 day suspension on the first violation and 7 day suspension on the second violation for preparing the findings and order. There was a suggestion the employees be required to attend seller/server training. Special Prosecutor Gollin suggested 3 days suspension for the first offense, on the second offense 14 days suspension with 7 held in abeyance and the condition all employees attend training. Authority members gave final direction to the Authority Attorney to prepare the findings and order with 4 days suspension for the first violation and 10 days for the second violation. Authority members thanked Special Prosecutor Gollin. F. Conversation with Chief Hayes Chief Hayes noted he and Sergeant Redard have discussed getting reports to the Authority in a timely manner.
