He knew the police would be by later so he
didn't call the police at the time of the incident.
Tennessen asked why the police weren't called at the time of the incident. Mr.
Thies said he went about his business and the police arrived moments later.
Machado noted the bar tab showed the time a few minutes before midnight. Mr.
Thies said he was not positive of the timeframe as they were busy.
Mr. GoIlin asked if Mr. Thies ever told the other bartender to call the police that
night. Mr. Thies said no.
Witness was excused.
Prosecutor GoIlin called Corporal Treasure and she took the oath. She reported
she has been a corporal with the Louisville Police Department for approximately
six months. She was on duty as a police corporal on the night in question. As
part of her normal duties, she and another officer were conducting a bar check at
Henry's Bar and Grill at about 1:20 AM.
Mr. GoIlin noted the previous witness reported the incident happened a short
time after 11 PM. Corporal Treasure confirmed she arrived at the bar
approximately two hours later. She noted Mr. Thies was very upset and out of
sorts. Shaking a bit and concerned about his welfare when he left the bar at the
end of the shift. He asked the police to be around when he left.
Corporal Treasure reported there was an attempt by another police department
to contact the person who allegedly threatened Mr. Thies, but contact was
unsuccessful.
Mr. GoIlin and Corporal Treasure reviewed the threats made to Mr. Thies as he
reported them to the police that night and the possible charges the person
threatening Mr. Thies could have received.
Chairperson Lipton called for closing statements noting the licensee was not
present.
Attorney Gollen noted the purpose of the law about reporting is so any time
something is happening in an establishment, the police are called so it does not
get worse. These offenses are strict liability which means it doesn't matter what
the intent was in the person who called, but that they have to call.
Chairperson Lipton closed the hearing and asked for deliberation.
Members discussed the testimony.
