Absent: Council member Brown. <br /> <br />ORDINANCE NO. 1435, SERIES 2003 - AN ORDINANCE AUTHORIZING THE <br />PAYMENT OF CITY MONEYS FOR THE ACQUISITION OF A PARCEL OF <br />VACANT REAL ESTATE FOR PARK AND RIGHT-OF-WAY PURPOSES - 2nd <br />reading - public hearing (advertised Daily Camera 12/20/03 & 1/11/04) <br /> <br />RESOLUTION NO. 4, SERIES 2004 - A RESOLUTION APPROVING A <br />PURCHASE CONTRACT TO BUY AND SELL VACANT REAL ESTATE FOR <br />PARK AND RIGHT-OF-WAY PURPOSES <br /> <br />Mayor Sisk called for City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1435, Series 2003 <br /> <br />Mayor Sisk called for Staff presentation. <br /> <br />City Manager Bill Simmons reported on the acquisition of a 3.5-acre parcel located on <br />the north side of Spruce Street between the eastern and western ends of Walnut Street, <br />owned by Bruce R. Savage and Ilene C. Savage. The total purchase price is $322,000. <br />The Savage family currently own about 5-acres and the City will purchase 3.5 acres. The <br />City and the sellers will annex the entire parcel. The Savage family will develop one acre, <br />consisting of one existing house and two building sites. The intent is to use the lots for <br />residential purposes within the City's Single-Family Low Density (SF-LD) zone district. <br />The City agrees to provide, at no charge, a sewer tap to the existing single-family <br />residence. The City also agrees to construct a fence along the south boundary of the City <br />property. The 3.5 acres combined with the Smethill and Pickett properties, will create an <br />area of about 6.48 acres for a future park. The acquisition will allow the City to construct <br />the last link of the trail running from Cottonwood/Lake Park to the Coal Creek Trail at <br />the Cherry Street pedestrian underpass. Staff requested the Council action allow for a <br />portion of the property to be used for right-of-way purposes to allow a permanent turn- <br />around to be constructed on Walnut Street at the west side of the property. The funds for <br />the acquisition will come from the Capital Projects Fund. <br /> <br /> <br />
