Louisville City Council Meeting <br />January 20, 2004 <br />Page 6 of 11 <br /> <br />Mayor Sisk opened the public hearing and asked if anyone in the audience wished to <br />speak for or against Ordinance No. 1435, Series 2003, or Resolution No. 4, Series 2004, <br />and hearing none, closed the public hearing. <br /> <br />MOTION: Mayor Pro Tern Keany moved that Council approve Ordinance No. 1435, <br />Series 2003, seconded by Council member Levihn. Roll call vote was taken. The motion <br />passed by a vote of 6-0. Absent: Council member Brown. <br /> <br />MOTION: Council member Van Pelt moved that Council approve Resolution No. 4, <br />Series 2004, seconded by Council member Marsella. Roll call vote was taken. The <br />motion passed by a vote of 6-0. Absent: Council member Brown. <br /> <br />City Manager Simmons thanked the Savage Family and their agent Rod Wilcox, for their <br />cooperation. <br /> <br />REQUEST FROM TOWN OF SUPERIOR TO AMEND US 36 <br />INTERGOVERNMENTAL AGREEMENT (IGA) <br /> <br />Mayor Davidson called for Staff presentation. <br /> <br />City Manager Bill Simmons reported the Town of Superior has requested an amendment <br />to the 1997 Superior-Louisville US 36 IGA. The IGA was a mutual commitment to <br />jointly plan the reconstruction of the McCaslin Interchange. It also established US 36 as <br />the logical boundary between Louisville and Superior and resolved land use issues <br />between the two municipalities. One of the provisions of the agreement was that <br />Superior was to share fifty percent of the amount of revenues received from a 2.7% sales <br />tax rate from commercial development in the property. Further, Superior shall not allow <br />residential use on the property except for eight acres for senior housing. Superior is <br />requesting this provision be amended to allow multi-family residential uses as part of a <br />"town center" mixed-use development. Simmons reported the Superior Town Manager, <br />Bruce Williams would discuss the proposed amendment. <br /> <br />Superior Town Manager Bruce Williams reviewed the requested amendment. He <br />explained at the time of the IGA there was no intention to develop the property as <br />residential. He explained the Town of Superior plans to develop a mixed-use <br />development, which includes affordable housing units and commercial. <br /> <br />COUNCIL COMMENTS <br /> <br />Council member Van Pelt asked how much of the acreage would be residential. Williams <br />stated the development is in the preliminary stages and the number of residential units has <br />not be calculated. He stressed the Town of Superior intends to maximize the commercial, <br />and stated housing alone would not be appropriate. <br /> <br />6 <br /> <br /> <br />
