Louisville City Council Meeting
February 17, 2004

and is scheduled to expire in February of 2004. The PUD plan included four outlots; two
commercial lots and one potential residential lot. Any approved PUD plan must start
construction on or before 36 months have passed from final PUD approval by Council.
The Applicant is seeking a three-year extension of the right to build on Lot 2 in the
Summit View development. The extension would take the project to February 2007.

Wood explained that since the initial approval was granted in 2001, no building permits
have been issued, and no changes are requested to the overall PUD site plan. The
extension allows the applicant to meet their development goals and continue the planning
and construction of the project in the near future. The development of Lot 2 of the PUD is
proposed for a 7,500 square foot professional office building. Lot 1 of the PUD has been
developed into a 29,000 square foot medical/dental office building and parking.

John Gstalder, representing the applicant, requested a three-year extension on the Summit
View Subdivision PUD.

Mayor Sisk called for public comments. There were no comments.

COUNCIL COMMENT

Council member Brown asked how the citywide comp plan would affect the Summit
View Subdivision PUD. Planning Director Wood stated the property has the underlying
zoning, however there may be an issue of providing a secondary access.

Council member Brown stated an additional access would be a benefit to the developer,
but would require an amendment to the PUD. Gstalder agreed an additional access would
be beneficial, but would not change their proposal for a low density use building.

Mayor Sisk inquired as to the date of the extension. Gstalder voiced his belief the PUD
was approved on February 6, 2001.

MOTION: Mayor Pro Tem Keany moved that Council approved Resolution No. 8,
Series 2004, seconded by Council member Brown.

Mayor Pro Tem Keany amended his motion to extend the PUD to February 17, 2007.
Council member Brown accepted the amendment.

VOTE: All in favor.

RESOLUTION NO. 9, SERIES 2004 - A RESOLUTION APPROVING A CITY
POLICY REGARDING PAYMENTS FOR CLEANUP EXPENSES RESULTING
FROM SEWER BACKUPS

Mayor Sisk called for Staff presentation.
