Louisville City Council Meeting <br />April 20, 2004 <br />Page 9 of 15 <br /> <br />lots for residential purposes within the City's Single-Family Low Density (SF-LD) zone <br />district. It is a condition precedent to closing that annexation, zoning, subdivision and <br />PUD approval are obtained from the City. The City agrees to provide, at no charge, a <br />sewer tap to the existing single-family residence. The City also agrees to construct a <br />fence along the south boundary of the City property. <br /> <br />Wood reviewed the Planning Commission recommendation of approval of the Savage <br />application request for zoning, platting and the final PUD plan with the following <br />conditions: <br /> <br />1. A 31-foot height limit for each structure constructed on Lots 1, 2 and 3 shall also <br /> include a 2nd floor area restriction of 75% of the total square footage of the first <br /> floor area; <br />2. Prior to recordation, the Savage Subdivision Plat shall correctly label the 60-foot <br /> prescriptive easement of the Goodhue Ditch Company that is found along the <br /> Goodhue Ditch on the Savage property; <br />3. The Zoning Requirements Charts for the Savage PUD shall be adopted as part of <br /> the final PUD plan. <br /> <br />Mayor Sisk called for applicant presentation. <br /> <br />Rod Wilcox, Agent for the Savage family, provided background information on the <br />Savage property. He reviewed the negotiations between the City and the Savage family, <br />and the merits of the annexation and the two new proposed lots. He stated there is a party <br />interested in purchasing one of the lots to construct a Victorian home. He addressed the <br />requested setbacks, the lot coverage and the height variance for Lot 1. <br /> <br />PUBLIC COMMENT <br /> <br />Teri Kristovich, 310 West Spruce Street, Louisville, CO, stated she was the developer of <br />the Tree Haven Subdivision, and was concerned about the street recovery fee due to her. <br />She reported being told by the City that she would not receive any recovery for the <br />Pickett or Savage properties. She stated the Treehaven Subdivison Agreements outlines <br />her recovery fees upon development of the Pickett and Savage properties, therefore, she <br />hired Attorney Jessica H. Catlin, to represent her in this matter. <br /> <br />Jessica H. Catlin, Stevens, Littman, Biddison, Tharp & Weinberg, LLC, 250 Arapahoe, <br />Suite 301, Boulder, CO, representing Ms. Kristovich, addressed the March 31, 2004 letter <br />sent to City Attorney Sam Light. The letter outlined the contract that was signed by the <br />City of Louisville in 1995, and provided the one-half cost reimbursement to Kristovich <br />when the West Spruce Street properties were subdivided. She requested the City respond <br />to her letter, and make a good faith effort to reimburse her client. <br /> <br />City Attorney Sam Light reviewed the scope of action before the Council, and noted the <br />Pickett's have requested a continuance on their annexation, therefore the only action <br /> <br />9 <br /> <br /> <br />
