Louisville City Council Meeting <br />May 4, 2004 <br />Page 8 of 11 <br /> <br />Council member Keany asked if a PUD is required. Wood stated it didn't appear there <br />were any zoning requirements requiring PUD relief. He voiced his belief the process <br />could go through a subdivision replat process without a PUD. <br /> <br />Council member Keany asked if the drawings were acceptable in the subdivision <br />agreement. Leffingwell stated the agreement does not include all the agreed upon caveats. <br /> <br />Mayor Sisk voiced his concern with the statements Mr. Waldman made relative to the <br />City Staff and the City Attorney's opinion. Waldman explained Barnes and Leffingwell <br />have accepted the framework agreement, which he presented. He voiced his concern the <br />rules would change again. <br /> <br />Mayor Sisk explained to Mr. Waldman that the Council must consider the legal opinion <br />forwarded by the City Attorney. He stated if Council ignored the City Attorney's legal <br />opinion, the Council would put the City at risk. <br /> <br />Council member Keany suggested Council continue the Faber Annexation Agreement <br />Amendment request until there is a signed agreement between Waldman and Leffingwell. <br /> <br />City Attomey Light stated continuing the matter is an option. He noted a property owner <br />can pursue the subdivision process. Mr. Waldman stated he presented the agreed upon <br />framework for the property. He stated his concern centered on the continual changing of <br />the rules. <br /> <br />Council member Brown reviewed the options outlined by the City Attorney and voiced <br />his willingness to have the homeowners work out the issues. He asked if the HOA has <br />taken any action. Mr. Grice stated the HOA has taken no position in the matter. <br /> <br />MOTION: Council member Van Pelt moved to continue the Amendment to the Faber <br />Annexation Agreement to June 1, 2004. Council member Brown seconded the motion. <br /> <br />Council member Brown asked Mr. Leffingwell if he was opposed to moving forward <br />with the Faber Annexation Agreement amendment. Mr. Leffingwell stated he is not <br />opposed to moving forward. <br /> <br />Mayor Sisk offered a friendly amendment directing Staff to participate in the <br />formalization of the agreement. Council members Van Pelt and Brown accepted the <br />amendment. <br /> <br />VOTE: Roll call vote was taken.
