City Council <br />Meeting Minutes <br />June 3, 2008 <br />Page 8 of 11 <br />LOUISVILLE MIXED USE RESIDENTIAL (MU-R) - 2"d Reading -Public <br />Hearing <br />Mayor Sisk requested a City Attorney introduction. <br />City Attorney Light read Ordinance PJo. 1535, Series 2008. <br />Mayor Sisk opened the public hearing and requested a Staff presentation. <br />Planning Director Wood explained the applicant/owner, Aggregate Industries <br />West Central Region, Inc., represented by Mr. Kent Bagley, has initiated a <br />voluntary request to rezone the subject property from the City of Louisville <br />Industrial (I) to City of Louisville MixE:d Use Residential (MU-R). The northerly <br />portion of the parcel (north of Short ;street) was platted in 1959 as part of the <br />Industrial Area Subdivision. The 4.9~ acre parcel is part of the Highway 42 <br />Revitalization area and is currently occupied by a concrete batch plant and <br />associated building structures. The plant has operated under different ownership <br />from 1963 to 2000. Over the past few years Aggregate Industries has <br />transferred their operations to their E3roomfield facility. <br />The applicant/owner is not petitioning for the entitlement of a PUD development <br />plan. The application materials characterize the lack of a PUD development plan <br />as part of the rezoning as a waiver cif the code requirement. While it is not their <br />intent to submit a redevelopment plan, they have indicated such future <br />redevelopment will be in full compliance with the provisions and design standards <br />of the MU-R District. <br />The proposed rezoning is necessary in order to provide land for a community <br />related use, which was not anticipatf:d at the time of the adoption of the City's <br />Comprehensive Plan. Such rezoning will be consistent with the policies and <br />goals of the Comprehensive Plan. <br />The Zoning Agreement specifies all Future development will comply with adopted <br />zoning, subdivision, and applicable design standards at the time of development. <br />Further prior to the development of the property, the entire parcel shall be <br />replatted in accordance with the subdivision ordinance. Staff recommended the <br />Ordinance not be signed or published until the applicant has first executed and <br />returned the Zoning Agreement. <br />The Planning Commission conducted a public hearing on April 10, 2008 and <br />recommends approval of the MU-R rezoning without conditions. <br />APPLICANT PRESENTATION <br />
