City Council <br />Meeting Minutes <br />June 17, 2008 <br />Page 12 of 14 <br />grandfather clause and suggested the City look at the safety issues and not the <br />aesthetic issues. <br />COUNCIL COMMENT <br />Councilor Sackett noted he lives in an area that already has restrictions. He felt <br />the ordinance could be modified. HE; agreed one size fits all is not a good law. <br />He suggested a grandfather clause or using the Board of Adjustment. He <br />requested the Council postpone the passing of the ordinance to review property <br />rights provisions. <br />Councilor Yarnell supported using the Board of Adjustment, but not a grandfather <br />clause. She supported a method of evaluating a process. <br />Councilor Muckle and Mayor Pro Tem Marsella concurred with Councilor <br />Yarnell's comments. Mayor Pro Tenn Marsella supported the Board of <br />Adjustment's review, and a 5-foot setback. She was concerned with the 24-hour <br />loading and unloading clause and the encroachment to the sidewalk. <br />Councilor Clabots concurred with Councilor Sackett's comments that one size <br />law does not fit all, especially in Old Town. <br />Mayor Sisk noted many communities have similar ordinances. He stated there <br />was a public process. He noted the side yard setbacks in Old Town could be <br />exceptions to the ordinance. He supported the Board of Adjustment variance. <br />Planning Director Wood addressed t;he Board of Adjustment's administration <br />process and suggested eliminating the 5-foot setbacks on all residential side lots. <br />Mayor Pro Tem Marsella stated her concern eliminating the 5-foot setbacks <br />would permit large high profile vehicles within the side yards. <br />Councilor Sackett noted the Board o~f Adjustment process should also include a <br />public hearing, posting and notice to the neighbors. <br />PUBLIC COMMENTS <br />Howard Pollack, 834 Lincoln AvenuE:, Louisville, CO stated the Council has not <br />addressed construction trailers on City streets. <br />Randy Luallin, 301 East Street, Louisville, CO stated this is not a safety issue. He <br />stated the ordinance is far too complicated. He was opposed to the ordinance. <br />Mr. Karpel, 928 LaFarge Avenue, Louisville, CO was not in favor of removing the <br />5-foot setbacks. <br />
