The latest <br />possible time to adopt an emergency ordinance would be September 4t". The <br />ballot must be certified by September 5t". The ordinance would not be in effect <br />when the ballot is certified, however the measure would still go to the voters. <br />The ballot title can also be drafted thirough a resolution. Another option would be <br />to adopt an ordinance on second reading with all the provisions, with an effective <br />date based upon passage of the ballot issue by the voters. <br />COUNCIL COMMENTS <br />Mayor Pro Tem Marsella stated her understanding a resolution would establish <br />the ballot language and the ordinanc;e's procedural process. <br />Councilor Muckle asked why an emergency ordinance could not be used prior to <br />September 4. City Attorney Light explained the ordinance would be in affect <br />before the certification of the ballot. <br />Councilor Muckle supported taking more time to perfect the ballot language. He <br />noted the significant changes to the ballot language are the Task Force, who will <br />make a recommendation of the incentive spending and the explanation of why it <br />is important to preserve the character of the downtown area. He suggested <br />incorporating incentives to new building construction to preserve the character of <br />the downtown area. <br />Councilor Dalton suggested a design review team. He felt the character of the <br />City should be reflected in the size of buildings and setbacks and suggested <br />paying a market incentive to an owner for keeping the character of the <br />community. <br />There was Council discussion relative to setting up a Task Force made up of <br />Council members, Historic Preservation Members, BRaD, Louisville <br />Revitalization Commission (LRC) ar~d members of the public. Incentives for new <br />construction as well as historic preservation of historic buildings were also <br />discussed <br />Councilor Sackett reported hearing comments from the public that this is a bad <br />time for the tax question. <br />Mayor Sisk addressed the downtown overlay and noted the grain elevator is not <br />included. Councilor Muckle stated the Miner's Field area is also not included. <br />Mayor Sisk pointed out the Task Force does not include any participation outside <br />the downtown area. He stressed it should be viewed as a community issue and <br />not just a downtown issue. He encouraged Council not to wait until September <br />4tn <br />
