City Council <br />Meeting Minutes <br />July 15, 2008 <br />Page 4 of 8 <br />request of the owner or the Planning Department as part of the referral process, <br />even if the application before the Planning Commission will include the <br />demolition of a building older than ~i0 years. Under the current process no <br />demolition review would take place as a part of the Planned Unit Development <br />(PUD) or Special Review Use (SRU) process unless an applicant applies <br />separately for a demolition permit. This process could create unnecessary <br />delays if the City requires an applicant to complete aPUD/SRU process, when <br />the HPC adds an additional 180 days to the process with a stay of demolition. <br />The two processes should run concurrently. The ordinance would allow the <br />planning process and the demolitioin review process to work more cohesively. <br />The ordinance amends the preservation ordinance in Chapter 15.36 of the <br />Louisville Municipal Code to allow the following: <br />Demolition review could be triggered by formally submitting a demolition <br />permit request. <br />Demolition review could be triggered by a referral from the Planning <br />Department when it is part of a PUD or SRU process. <br />A building owner could speak to the HPC abut the historic significance of a <br />site in preparation for a remodel or demolition without having to obtain a <br />demolition permit and without compromising the subcommittee review <br />process. <br />Items of note regarding the ordinance: <br />• The pre-filing conference is worded to be clear that nothing said at the <br />conference is binding to either the HPC or the building owner and a <br />demolition review is still regluired. <br />• The expiration of the demolition review remains the same for a standard <br />review triggered by a demolition permit (180-days). <br />• The demolition review when triggered by a PUD/SRU referral is tied to <br />the expiration of a PUD/SRU, which is three years and can be extended <br />if approved by City Council. It should be noted some members of the <br />HPC were concerned about leaving the expiration of the demolition <br />review open for three or more years. Their concern was based on the <br />thought the value of the building could change in that time depending on <br />the circumstances. <br />• The existing ordinance requires the subcommittee review be completed <br />within fourteen days. The proposed amendments increase the allotted <br />time to twenty one days to sallow staff more time to research the property. <br />The allotted time for a response to the applicant remains thirty days. <br />The Historic Preservation Commission reviewed the amendments on June 16tH <br />and forwards a recommendation of approval. <br />
