City Council <br />Meeting Minutes <br />September 2, 2008 <br />Page 5 of 13 <br />financing program. Assistant City Manager Balser introduced Boulder County <br />Sustainable Coordinator Ann Livingston. <br />Assistant City Manager Balser explained the local improvement district provides <br />a voluntary mechanism to residential and commercial property owners to obtain <br />affordable financing for renewable energy improvements. Only property owners <br />who elect to participate in the program would actually pay for improvements <br />through a property tax assessment. It is not a sales or use tax. The program is <br />voluntary and property owners would have the ability to "opt-in" to the program <br />for a loan value specific to the type of improvement they elect to choose. <br />Mayor Sisk requested public commE;nt. There were no comments. <br />COUNCIL COMMENT <br />Mayor Pro Tem Marsella supported the program and asked what would happen if <br />the ballot issue did not pass. Ms Livingston explained if it does not pass, there <br />would not be a Clean Energy Options Local Improvement District. If the Council <br />does not approve the ordinance, the residential and commercial property owners <br />in the City will not be able to participate in the program if the ballot issue passes. <br />Mayor Sisk noted this would be beneficial to the business community. He noted <br />the federal tax credit is scheduled to expire on February 1, 2009 and suggested <br />interested parties contact their legislators and request the tax be extended. Ms. <br />Livingston stated they are working with federal delegates to extend the deadline. <br />Assistant City Manager Balser noted Planning Director Paul Wood requested an <br />amendment to the agreement, on Page 2, Section , to add "subject to local land <br />use and zoning requirements" to read: Section 1. The City hereby consents, as <br />provided in Section 30-20-603(1)(a), Colorado Revised Statutes, as amended, to <br />renewable energy systems and energy efficiency improvements being installed <br />upon any private property within the City, "subject to local land use and zoning <br />requirements," through Boulder County's Clean Energy Options Local <br />Improvement District, upon its formation pursuant to the Act, in order that owners <br />of properties located anywhere within the City may voluntarily include within such <br />District and apply to participate in the County's program subject to land use and <br />zoning requirements. <br />Mayor Sisk closed the public hearing. <br />MOTION: Mayor Pro Tem Marsella moved to approve Ordinance No. 1539, <br />Series 2008, as amended on Page 2, Section 1, adding the phrase "subject to <br />local land use and zoning requirements." Councilor Bob Muckle seconded the <br />motion. Roll call vote was taken. The motion carried by a vote of 7-0. <br />
