6,18/84 Page -20- <br />Administrator Wurl advised that the City <br />i:~ currently providing water to everybody <br />along Continental View Drive with the <br />exception of Lot 17 and Mr. Kuykendall. <br />Mr. Wurl also stated that we have always <br />considered Mr. Kuykendall's property to <br />be in the urban services area. As a bit <br />of= background history on the houses in this <br />area, Administrator Wurl stated that some <br />of= the homes were allowed to tie into the <br />City's raw water line and a group of the <br />owners went together and bought a small <br />filter plant which supplied 3-4 houses. <br />Then the Health Department was down on the <br />City for allowing this to happen. The under- <br />standing was that the minute potable water <br />was available to the residents in that area, <br />they. would connect to the City, and they <br />dial connect around 1977-1978. It was his <br />feeling that everybody in the area was <br />solicted to do this at that time, and he <br />felt Mr. Kuykendall was referring to this <br />when he stated he should have taken advantage <br />ofd this at that time. Mr. Wurl stated that <br />ir.~ the old, old contracts there was a re- <br />qu~irement that these people annex to the City. <br />Ma~.yor Meier commented that it was his under- <br />standing that these people were also to be <br />connected with the City's sewer system; be- <br />cause at the time the City's. water rights <br />were acquired on a consumptive use basis, <br />sa the water could be reused. <br />Adiministrator Wurl stated that he was not <br />certain that these residents had agreements, <br />anal if they did they weren't enforced when <br />they tied onto the City system. They do <br />have a different situation than the normal <br />type flat-lot because most of the ceptic <br />systems go toward the downhill side of <br />th.e properties and it is almost impossible, <br />from a grade point of view, as you <br />would have to reverse the plumbing in all <br />th.e houses to get that to tie on to the <br />City's sewer system. <br />Councilman Leary Inquired if this property were eligible for <br />annexation. <br />Administrator Wurl stated if in fact his new <br />driveway is owned by him, then he would be <br />contiguous to the City. <br />Mr. Kuykendall stated that it was not owned <br />by him - it was a County right-of-way. <br />Mr. Wurl stated the parcel abutting his <br />
