4/'19/84 <br />Page -13- <br />Filling the Vacancy Discussion was held whether to appoint someone <br />Created by Councilman Woodson or hold a special election to fill the vacancy <br /> of: Councilman Woodson. <br />Councilman Leary Inquired of the City Attorney what the time <br /> frame and procedure was for setting a Special <br /> Election. <br /> His reply was there needed to be at least <br /> a 30 day notification, for proper publication, <br /> etc. Council should give themselves a few extra <br /> days to be certain that those things can be <br /> accomplished. The registration time frame <br /> must also be met and since this is a general <br /> election year it will be difficult for the <br /> County to cut off the registrations in Ward <br /> III and register on a deferred basis. <br />RECESS Mayor Meier called a recess at 10:30 P.M. <br /> while Attorney Rautenstraus researched the <br /> statutes regarding a Special Elections. <br /> Meeting reconvened at 10:40 P.M. <br />Attorney Rautenstraus advised by Statute <br />Council did have an alternative of either <br />appointing someone or setting a Special <br />Election. A special election cannot be <br />called within 30 days; it can't be held <br />within 90 days preceding a regular election; <br />it c:an't be held within 32 days before or <br />aftE:r the date of a primary, general, or <br />Congressional vacancy election. <br /> Mayor Meier and Councilman Leary favored <br /> having a Special Election. Councilmembers <br /> Cus:~en, Luce, Johnson and Morris favored <br /> advE~rtising and appointing someone. <br />Motion to Appoint Someone Councilwoman Morris moved, Councilwoman John- <br /> son seconded that we advertise for an inter- <br /> estE.d person from Ward III to be part of our <br /> City Council as part of an appointment. <br />Motion Withdrawn After further discussion and a persuasive <br /> agrument by Councilman Leary, Councilwoman <br /> Morris withdrew her motion and Councilwoman <br /> Johnson withdrew her second. <br />lotion for Special Election Councilman Leary moved, Councilman Cussen <br /> seconded that a special election be held <br />
