VOTE ON THE MOTION TO Question called for. 5 Ayes, 1 Nay, and PUBLISH ORDINANCE #820 1 Abstain. Coun cilman Luce dissenting, AND SET PUBLIC HEARING Councilman Leary abstained. Motion carried 5-l. ORDINANCE #821 - ESTABLISH- Councilmembers had a copy of the ordinance; ING A COURT OF RECORD Attorney Rautenstraus read it by title only on first reading and the request was for publication; also if Council so desired that a public hearing be set. PUBLICATION AUTHORIZED AND Councilman Cussen moved, Councilman Luce PUBLIC HEARING SET seconded that Ordinance #821 - Establishing a Court of Record be published and a public hearing set for February 21, 1984. Question called for. All in favor. Motion carried unanimously. REFERENDUM PEITIONS ON Attorney Rautenstraus advised that as Council ORDINANCE #808 - HOMART was aware, referendum petitions protesting REZONING they passage of Ordinance #808 were filed with the City Clerk and the Clerk did verify that an adequate number of signatures were on the petitions. He was not certain how council wished to proceed with this matter, but: it seemed to him appropriate if they deg>ire that a public hearing might be set to consider the petitions; suggested February 7, 1984 as a proper date. PUBLIC HEARING SET FOR Mayor Meier moved, Councilman Leary seconded FEBRUARY 7, 1984 that a public hearing be set on February 7, 1984 on the Homart referendum petitions. Councilman Luce stated he would like to spE:ak in favor of the motion, as he would cez-tainly be interested in hearing from the people who circulated the petitions, as well as from those who signed it precisely where thE:y are coming from and he felt the best way to do that would be in a public forum; therefore would urge council to pass this item.
