Motion carried <br /> 5-l. <br />ORDINANCE #821 - ESTABLISH- Councilmembers had a copy of the ordinance; <br />ING A COURT OF RECORD Attorney Rautenstraus read it by title only <br />on first reading and the request was for <br />publication; also if Council so desired that <br />a public hearing be set. <br />PUBLICATION AUTHORIZED AND Councilman Cussen moved, Councilman Luce <br />PUBLIC HEARING SET seconded that Ordinance #821 - Establishing <br />a Court of Record be published and a public <br />hearing set for February 21, 1984. Question <br />called for. All in favor. Motion carried <br />unanimously. <br />REFERENDUM PEITIONS ON Attorney Rautenstraus advised that as Council <br />ORDINANCE #808 - HOMART was aware, referendum petitions protesting <br />REZONING they passage of Ordinance #808 were filed <br /> with the City Clerk and the Clerk did verify <br /> that an adequate number of signatures were <br /> on the petitions. He was not certain how <br /> council wished to proceed with this matter, <br /> but: it seemed to him appropriate if they <br /> deg>ire that a public hearing might be set <br /> to consider the petitions; suggested February <br /> 7, 1984 as a proper date. <br />PUBLIC HEARING SET FOR Mayor Meier moved, Councilman Leary seconded <br />FEBRUARY 7, 1984 that a public hearing be set on February 7, <br /> 1984 on the Homart referendum petitions. <br />Councilman Luce stated he would like to <br />spE:ak in favor of the motion, as he would <br />cez-tainly be interested in hearing from the <br />people who circulated the petitions, as well <br />as from those who signed it precisely where <br />thE:y are coming from and he felt the best <br />way to do that would be in a public forum; <br />therefore would urge council to pass this item. <br />
