Roll call vote: <br />Cussen Yes <br />Leary Yes <br />Meier Yes <br />Luce Yes <br />Morris Yes <br />Johnson Yes <br />Woodson Yes <br />Motion carried unanimously. <br />ORDINANCE #820 - EMISSION CONTROLS <br />AUTOMOBILE Councilmembers had a copy of the ordinance; <br />Attorney Rautenstraus read it by title only <br />on first reading; the request was for publi- <br />cation and if council so desired to set a <br />public hearing. <br />AUTHORIZATION FOR PUBLICATION Councilwoman Morris moved, Councilman Cussen <br />seconded that Ordinance #820 - Emmission <br />Controls - Automobile be published and a <br />public hearing set for February 21, 1984. <br />Councilman Leary stated that he would abstain <br />from voting on this matter since the organi- <br />zation he works for administers the program. <br />Councilman Luce commented that he was curious <br />as to the rationale of the stiffness of the <br />fir.~e - a maximum of $300.OG - what was the <br />justification for that? <br />Attorney Rautenstraus advised that $300.00 <br />is the standard maximum that can be charged <br />for' a municipal code violation. This enables <br />discretion for the court, if a person was <br />found guilty of this, to set the fine in that <br />range as set in the ordinance. In the event <br />thE; Court saw fit they could fine somebody <br />up to $300.00 for a violation. <br />
