11/7/84 Page -8- <br />Councilman Luce Referred to page 5 "Customary water tap <br />Water Tap 3% Inflationary fees" and asked why the up to 3% annually figure <br />Figure to cover infl<~tion was used rather than using <br />a standardedly agreed upon index? <br />Attorney Rautenstraus replied that his sug- <br />guestion was similar to Councilman Luce's <br />and more work needed to be done on this section. <br />He did not think it would be appropriate for <br />the City to be limited to a 3% increase entotal. <br />However, it might be possible to set a limi- <br />tation with respect to capital cost increases <br />and perhaps another limitation with respect <br />to 'the portion of the tap fees that goes to <br />water rights acquisition. He felt that it <br />would be worthwhile to consider changing <br />this term to put it more in line with an index, <br />etc. Attorney Rautenstraus commented that <br />he :Felt Homart was willing to consider this. <br />Councilman Luce referred to the blank space <br />under section C. on page 5 and asked when <br />this figure would be placed in the agreement. <br />Mr. Rupp advised that staff is reviewing this <br />and looking at. what portions of the City still <br />havf~ to be developed and trying to esti- <br />mate the number of units that might be approved <br />in certain portions of the community. He <br />also stated that there were certain areas <br />within the service area that have not yet been <br />annexed and staff is trying to derive how <br />many units might reasonably be expected to <br />come out of them. The information is now <br />on DQr. Rupp's desk and is awaiting consensus <br />of t=he .Engineering and Planning staff before <br />it will be presented to Council. <br />Councilman Luce commented that he didn't re- <br />ceive the Agreement until Monday evening <br />and was uncomfortable at this time, with an <br />agrE~ement of this complexity to review it <br />fu1T_y to make a decision on it. He would <br />likE~ other councilmembers to consider having <br />Attorney Rautenstraus incorporate the comments <br />being expressed this evening and then receive <br />a final draft.within the required time line <br />so council has ample opportunity to discuss it. <br />Acting City Administrator Rupp concurred with <br />Councilman Luce and stated that staff did <br />not expect Council to approve the agreement <br />thi:~ evening and Mr. Sthal of Homart was <br />
