11/7/84 Page -9- <br /> informed of this also. <br />Councilman Leary Commented there was an issue brought up <br /> that needed to be changed throughout the <br /> agreement then referred to Section 3.1 (a) <br /> on page 3 "customary water to fees as <br /> hereinafter defined, will satisfy all of <br /> Sub~divider's, its successors and the Land's <br /> obligations (and no other char es or im osi- <br /> tio:ns of any kind will be made, etc., and <br /> stated that we can't agree to put something <br /> in like that for either water or sewer. If <br /> EPA, i.e. decided that we had to treat our <br /> sewage to a higher degree and had to spend <br /> $2,000,000 expanding the plant, we have to <br /> be certain that everyone on the City shares <br /> that cost and not allow wording im the agree- <br /> ment that says there could be no impositions <br /> directly or indirectly against them again <br /> for water or sewer services. We may find <br /> something in our water planning for some <br /> reason that wE~ would have to add something <br /> new to our system, and if this needs to be <br /> bonded we certainly would not want people <br /> on -the Homart land being exempt. <br /> Councilman Leary stated this needs to be <br /> added in on page 4 (1) Water utility improve- <br /> ments. <br />Water Acqisition Mr. Leary stated that he did not feel a <br /> specific limit: could be placed on water acqui- <br /> sition, as it is essentially a supply and <br /> dem<~.nd issue - not an inflationary issue. <br />Amendments to Annexation Councilman Leary stated we need to get working <br />Agreements with Columbine on <~.mendments to the annexation agreements <br />and McStain witlZ Columbines and McStain to get them in <br />official form. <br />David Stahl, 1459 Franklin Mr. Stahl stated that they had taken the <br />Ave. Representing Homart comments that Attorney Rautenstraus had sub- <br />mit~~ted to them on Friday and also the comments <br />that the Council made this evening. and felt <br />than some of them were easy changes to make <br />to clarify the language; others are more <br />dif:Eicult for them to deal with, i.e. the <br />18" water line on Cherry St. This was a com- <br />men~~t from the staff as to the portion of their <br />responsibility. The water tap fee increase <br />in <~ variable way as opposed to fixed - their <br />concern was that they get down to a point <br />
