9/18/84 Page -12- <br /> Consultants estimates are 2.8 million. <br />commitments The second part of their first constraint <br /> would be contributing the money for the <br /> north water treatment plant is that the <br /> City would have to commit and give them <br /> some subtantial assurance that if there <br /> were additional needs in the treated <br /> water lines storage facility prior to 1989 <br /> whcn the Howard Berry plant came on line <br /> that they would have the ability and would <br /> provide those facilities pursuant to the <br /> development agreement. <br /> Secondly they would agree to give or pro- <br /> cess immediately the $124,000 which is <br /> their commitment for their portion of the <br /> 60" line and the outlet works. <br />Building Permits Third they would commit to purchase up to <br /> 100 building permits in 1985, with the pro- <br /> vision that if they cannot use the permits <br /> in 1985 that they could utilize them in 1986; <br /> and that those 100 permits could not be de- <br /> manded of them nor to create a surplus in <br /> the City's water fund. <br /> The City would agree to lift the moratorium <br /> and would like clarification on the commer- <br /> cial moritorium. <br /> That the sewer plant agreement would be <br />Sewer Plant Agreement addressed in any type of an amendment to <br /> their current agreement <br />Recovery Recovery - the City is now using a residential unit <br /> number that is less in their comp plan than <br /> was utilized in the development agreement. <br /> If those numbers are verified and correct, <br /> that the current assessment that is being <br /> made to repay the $1,368,000 to Homart <br /> would be adjusted so that it would coincide <br /> with the number of units that are in the <br /> balance of the planning area. <br />Design Fees At the reggest of Councilman Fauson, Mr. <br /> Stahl estimated the cost of the design fees <br /> for the Howard Berry Plant would be less <br /> than $8,000. <br />Request for Written Acknow- Councilman Leary requested that Mr. Stahl <br />ledgement of Commitments give us all this in writing. Mr. Stahl <br />stated that he would do so as soon as <br />possible. <br />Mark Klee - Rocky Mountain Mr. Klee stated that their figures had not <br />Consultants been refined and the 2.8 million dollar <br />figure that was presented by Mr. Stahl was <br />
