8/21/84 Page -16- <br />Councilman Cussen <br />ORDINANCE NO. 839 ADOPTED <br />surprised that it would be limited at 27' <br />but. if it is the wish of the Council, he <br />will abide by that in the annexation agree- <br />ment . <br />Commented that the people who built in the <br />Continential View Subdivision, with those <br />covenants in effect, felt that they were on <br />the edge of the City and therefore nothing <br />over a given heigth would be obstructing <br />their view, and maybe the fact that Mr. Pliska's <br />was the only vacant lot and is already un- <br />der construction at this point he saw it <br />as a good point. But he did think that it <br />was showing that Council was trying to also <br />to maintain the integrity of the convenants <br />of that area and the wishes of the people in <br />that subdivision. <br />Mr. Pliska stated that if he were to build <br />in Boulder County:- the same potential <br />risk of those homeowners would have been there. <br />Mayor Meier closed the public hearing. <br />Councilwoman Johnson moved, Councilman Fauson <br />seconded that Ordinance No. 839 - Pliska <br />Annexation be adopted. <br />In reply to Councilman Leary's question, <br />Attorney Rautenstraus advised that one <br />Annexation Agreement was done to cover both <br />Annexation Ordinances, so either ordinance <br />could be amended by the Annexation Agreement. <br />Roll call vote: <br />Meier <br />Cussen <br />Leary <br />Fauson <br />Johnson <br />Motion carried <br />Yes <br />Yes <br />Yes <br />Yes <br />Yes <br />unanimously. <br />ORDINANCE NO. 840 - PLISKA Councilmembers had a copy of the ordinance; <br />ANNEXATION - PUBLIC HEARING Attorney Rautenstraus read it by title only <br />on second reading and public hearing and cer- <br />tified proper publication. <br />Mayor Meier opened the public hearing and <br />Attorney Rautenstraus certified proper pub- <br />lication of public hearing notices. <br />
