8/21/84 Page -16-
Councilman Cussen
ORDINANCE NO. 839 ADOPTED
surprised that it would be limited at 27'
but. if it is the wish of the Council, he
will abide by that in the annexation agree-
ment .
Commented that the people who built in the
Continential View Subdivision, with those
covenants in effect, felt that they were on
the edge of the City and therefore nothing
over a given heigth would be obstructing
their view, and maybe the fact that Mr. Pliska's
was the only vacant lot and is already un-
der construction at this point he saw it
as a good point. But he did think that it
was showing that Council was trying to also
to maintain the integrity of the convenants
of that area and the wishes of the people in
that subdivision.
Mr. Pliska stated that if he were to build
in Boulder County:- the same potential
risk of those homeowners would have been there.
Mayor Meier closed the public hearing.
Councilwoman Johnson moved, Councilman Fauson
seconded that Ordinance No. 839 - Pliska
Annexation be adopted.
In reply to Councilman Leary's question,
Attorney Rautenstraus advised that one
Annexation Agreement was done to cover both
Annexation Ordinances, so either ordinance
could be amended by the Annexation Agreement.
Roll call vote:
Meier
Cussen
Leary
Fauson
Johnson
Motion carried
Yes
Yes
Yes
Yes
Yes
unanimously.
ORDINANCE NO. 840 - PLISKA Councilmembers had a copy of the ordinance;
ANNEXATION - PUBLIC HEARING Attorney Rautenstraus read it by title only
on second reading and public hearing and cer-
tified proper publication.
Mayor Meier opened the public hearing and
Attorney Rautenstraus certified proper pub-
lication of public hearing notices.
